CS writes to PGM (Finance) regarding looking after arrangement in AO and CAO cadre View Letter
As discussed earlier with PGM(F) on 31/10/2016, we reiterated our request for providing looking after arrangement in AO and CAO cadre in Kerala Circle.
It is learnt that considerable number of CAO posts are lying vacant in Kerala Circle following the recent promotion of CAO cadre to DGM cadre. In TVM alone 22 CAO posts are sanctioned including O/o CGMT, Mobile, Electrical, RTTC and SSA, whereas the present working strength is only 14.
A number of AO posts are also lying vacant in various business areas. In this year nearly 100 JAOs were appointed in the Circle and hence these vacancies can be filled by looking after arrangement from feeder cadre of AO and JAOs. In this context, we requested Administration that necessary steps may be initiated for providing Looking after arrangement in AO and CAO cadre in Kerala Circle at the earliest.

Congratulations to all the Comrades, As assured to SNEA on 22.12.2016, the decision to form a Committee to examine the pay parity issue in a time bound manner come out. As reported on 22.12.2016, the Minutes of the meeting held on 22.12.2016 with DIR(HR) on pay Parity of Rs 22820/- for post 2007 recruited JTO/JAOs issued today, as per the provisions of the Recognition Rules View letter.
This is another positive development and break through after the membership verification on 07.12.2016 where the Recognised Association can negotiate with the management on various HR issues. This shows that BSNL Management is also very keen to resolve the issues very quickly and responding very positively to our genuine demands. Earlier BSNL acted very fast on revised E2, E3 pay scales proposal and revised proposal got the approval of the MC within a week.

Congratulations..!! due to our continuous persuasion, finally Administration has released 107 EPP cases of E3-E4 for few business areas.View Orders
During the formal meeting with CGMT on 23/12/2016, we have expressed strong protest over the undue delay in this matter for last nearly 2 years. GM HR expressed the complexities involved and delays in getting VC/APAR etc. We have pointed out that there were more cases in the past and such delay was not experienced in the past. As far as non-receipt of VC/APAR is concerned if the list is made available the Association shall take the responsibility at SSA level to send the same in time. In the E4-E5 case CGMT is the Chairman of the committee which will be convened shortly and in future all efforts will be taken to avoid the delay.

Formal Meeting with CGMT Shri R.Mani on 23-12-2016, 14:30 Hrs
As a Recognized Executive Association of BSNL, this was first formal meeting with CGMT to discuss various pending HR issues as per agenda. GM(HR&Admin) Shri Mohan.D, DGM(Admin) Shri Satheesh and DGM(HR) Shri James Sagayaraj also attended the meeting.
The Recognized Association side was represented by CP Com.George Varghese, CS Com.Santhoshkumar, CT Com.Premkumar, CVP Com Asha & Com Narendrakumar, ACS Com.Ramana, AS(South) Com.Harikrishnan and DS-CO Com.Suneer.

1. JTO(T) postings and transfer request of JTOs competed 2 years:
The Association demanded to consider the transfer requests of all cases along with the new posting. But the administration wasn’t ready to consider the cases to TVM and EKM as the staff posting in these SSAs are much higher to the others. Finally it was agreed to consider the request of Lady Officers on compassionate grounds. The transfer request to other SSAs will be considered to the extent possible and all remaining cases will be cleared by March/April-2017. The new JTOs will be posted in their home SSA except that of TVM and EKM. As far as EKM is concerned we have pointed out that there are 2 Officers from High range and it was also agreed to consider posting them to high ranges on their request.

2. Phase-II training for JAOs:
The Association has pointed out the undue delay in the case and expressed our resentment in not following up the issue for the finalization of the training schedule. We were informed that the Circle office has sent a letter on 4-11-2016 but we have pointed out that no action has been taken by the circle for clarifying the doubts raised by the NATFM. On getting our letter on 16-12-2016, the Circle has specifically written to CGM NATFM for scheduling the Phase-II and Phase-III training. It was assured that the matter will be further persuaded in person from the Circle office with NATFM.

3. Gr.C to JTO(T) LICE promotion:
We have pointed out the acute shortage in JTO cadre and need for filling up the post at the earliest. We are unable to accept the stand of the Administration, just because some Court cases are filed the entire vacancies are reserved when there is no specific direction from the Court for such reservation. By the above attitude both the organisation as well as the officials is suffering. It was told that as court has given time for one month for submitting representation, the Administration have to wait till 8/1/2016 and final call will be taken based on the representations received. We have pointed out that since 181 officers are common they can be posted against 2014-15 vacancies for which they are duly eligible according to the administration and in case if any decision is taken in favour of 2013-14 vacancy, the vacancy position to be shifted to 13-14 from 14-15. We are in touch with the affected members as well as with CHQ for resolving this issue at the earliest.

5. Pay fixation of Officiating JTOs on regularisation:
We have pointed out that there is lots of anomaly in the case.
 They are not in receipt of their annual increment.
 They are not in receipt of 78.2% DA
 They are not in receipt of benefit of NEPP though the Admin say that their pay is to be fixed from substantive scale on IDA pay revisions etc.
We have suggested to extend them all benefits like increment, 78.2% DA merger , promotion under NEPP etc to which they are eligible according to Administration. It will put some light on the pay difference if any which will be useful in addressing the pending issues altogether. Finally administration agreed to work in this line and the officers will be able to take clear position in this regard.

6. DE(LA) arrangement:
The Circle office is ready with the panel and it was told that once any request from SSA Admin is received it will be processed. All SSA secretaries are requested take up the case once again with the SSAs for filling up the shortage.

7. Relieving of DEs to West Bengal Circle:
Association sought immediate intervention of Circle administration to retain all DEs under orders of transfer to West Bengal in Kerala circle itself. CGMT informed that there is pressure from Corporate Office to relieve the Officers to West Bengal before December 31st. We pointed out that the availability of regular DEs in Kerala circle has further gone down to mere 110 against the sanctioned strength of 382 which is below 30%. Regular DEs who were posted from Tamil Nadu & Karnataka to Kerala are transferred/being transferred back to their parent circle. Hence, we requested CGMT to write to Director HR once again in this regard. CGMT has assured to take up the matter with Corporate Office. Association has also requested CHQ once again to convince Corporate Office about the acute shortage of regular DEs in the circle and retain all of them here itself. We appreciated the effort taken by the CGMT and urged the Admin to stand by its view and not to relieve the officers until corporate office act by compulsory relieving through ERP. We have pointed out the case of GMs resorted by the Circle and requested to follow the same. Finally CGMT agreed not to relieve these Officers by 31st December as instructed by Corporate office so that the Association will continue its effort for their retention.

8. SDE (LA) in civil wing:
The Association expressed its protest over the anti HR attitude in this issue. We have pointed out that While CE-Civil (GM HR) is not ready to consider giving SDE LA at EKM to JTOs having more than 20 years service and in E4/E5 grade but he is ready to post SDEs from other Circles at EKM. It is really hurting and it has to be reviewed. Any way CE was trying to justify his stand to which we are not convinced. We are told that 2 SDE LA civil cases are in progress and that will be issued at KTM and TCR. Finally it was told that the officers from other Circle may not be joining and the case can be looked into on such occasion.

9. Transfer case of JTO (Electrical) Com.Akhilesh Chandran from Kannur:
The Association strongly taken up the case for cancellation as he was selected as pick and choose method by misuse of authority. Though initially it was told to take up with CE (Electrical) finally CGMT has agreed to review the issue after verifying the Stay particulars of JTOs at Kannur.

10. Misuse of official Authority in finance wing for promoting Association activities by AIBSNLEA:
We have pointed out many instances of misuse of authority by officers belonging to Finance wing at various SSA like TCR, CLT, TVM, PTA, PGT etc. We have requested the Administration to keep this aspect also in mind when any proposal in finance wing is mooted by the officers of the section.

Vindictive and discriminative action against SNEA members of Finance fraternity:
Association has registered strong protest before CGMT against the totally unjustified and indifferent attitude shown by Trichur SSA administration against transfer of two JAOs, who were booth agents of SNEA for membership verification, to rural stations without any rhyme or reason that too on the eve of referendum and after the office hours on 6th December 2016.Though PGMT Trichur, after our strong protest, had kept those orders in abeyance, certain officers in the administration with vested interests acted vindictively and insulted our members by allotting their seats to other JAOs despite directions from the PGMT. We have pointed out the attempt and threat for such instances in other SSAs also.
Association also registered strong protest before CGMT against the unjustified and unconvinced posting of newly appointed JAO Com.Sureshbabu from Trichur SSA to Kannur who got All India 3rd Rank in JAO LICE and 1st Rank in Kerala and also stood 1st Rank in JAO Phase-I training.
We have categorically informed circle administration that we will not allow any kind of vindictive actions against our members and would go to any extent to curb this highhandedness from any such corners in future.

11. Centralized Operation & Maintenance of Mobile Radio Network:
We have requested CGMT to initiate proceedings to bring back BSS/NQM units under CM Vertical of circle office as done before ERP implementation in September 2014 and as per Corporate Office guidelines issued from time to time. We apprised CGMT about the merits of having centralized monitoring/control of second line maintenance of radio network and strengthening RF optimisation activities in BAs after bringing them back under CM vertical to ensure the best possible Quality of Service to our esteemed customers in the circle. The Association suggested many ways to improve the Quality of service in mobile wing like bringing NQM activities under Circle mobile planning as in the case of Installation. CGMT responded positively and assured to discuss the same with GM Network Planning & Operations at least for NQM operations.

12. Allotting more seats in RTTC Trivandrum for JTO Phase two training:
We have requested CGMT to intervene and explore the possibility of allotting more candidates from Kerala circle to undergo JTO Phase two training at RTTC Trivandrum in Data Communication and Huawei GSM functions. CGMT assured to take up the case with the concerned in this regard.

13. SWAS Programme in Kerala Circle:
Association has pointed out that no concrete and visible action has been initiated by the Circle administration for promoting SWAS Programme in our circle. We requested CGMT to take into confidence all stakeholders to implement this Programme successfully in our circle also to ensure further growth in revenue and profit in the Circle especially in the current demonetization scenario to which CGMT agreed positively.
CGMT requested our support to increase revenue from Trivandrum & Ernakulam BAs in this financial year itself as the revenue growth from these SSAs are much less than other SSAs in spite of better staff position.. Our District Secretaries in these SSAs are hereby directed to conduct detailed deliberations with BA heads and to formulate strategies to enhance revenue from customers in all verticals.

CS writes to PGM(Finance) regarding issues being faced in Temporary Advance withdrawal and its settlement due to the current demonetisation drive. View Letter
The Centre’s demonetisation exercise has severely affected the withdrawal of temporary advance from bank in the field units. During ERP implementation, the Bank accounts were opened centrally at Union Bank, Kesavadasapuram, Trivandrum. Hence Account holders of other business areas can withdraw the temporary advance through ATM only. Due to the limitation of withdrawal and nonavailability of cash at ATMs, several attempts for several days was required to withdraw the full amount. In this context, it is we requested PGM(F) that the facility to withdraw the cash through withdrawal slip from any branch of Union bank in Kerala may be extended immediately and also requested to extend the time limit to submit the temporary advance settlement bill.

Triumphant Culmination of the Historic Kerala Struggle


The Leader who led the Historic Struggle, bore the brunt of Vindictive actions, stood like a ROCK in defeating Corruption, is finally honoured by the Corporate Office.

The first of the many vindictive actions served to the Valiant Kerala Comrades were bore by this Leader who was denied his Regular STS promotion in 2014 based on false Charge sheets. The Selfless Leader fought fearlessly for resolving vindictive actions of all other Comrades of SNEA Kerala, but in the process gave least importance to his own case. Comrades, Management finally withdrew all charges against this Leader and is today promoted as regular STS. With this all vindictive actions during Historic Kerala Struggle 2014/15 are resolved.

Hearty Congratulations to the Great Leader Com.George Varghese, CP of SNEA-Kerala who got Regular STS promotion today, w.e.f 21.08.2014. As Circle Secretary SNEA-Kerala he led the Historic Kerala Struggle and fought with Shri. MSS RAO, then CGMT KRL / Principal, RTTC Trivandrum against his corrupt practices. He was Charge sheeted, the entire comrades of Kerala / Circles / CHQ stood by him. As assured by the management all charges were withdrawn and today Com. George Varghese is promoted as Regular STS w.e.f 21.08.2014. View Promotion Orders

Grant of the facility of deduction of subscription to SNEA, the Recognised Representative Association in BSNL and general instructions governing deduction of monthly subscription View SR Cell order copy.
Congratulations to all: GS, CHQ President and Jt Sec met CMD on MC approval for E2, E3 pay scale issue. CMD informed that MC of BSNL Board in principle approved the revised proposal. MC further authorized DIR(HR) to discuss the proposal with AS(T), DoT and take their views also before sending it to DoT. The proposal need not go to MC again. This is a big step towards the resolution of the standard pay scale for the 2007, 2008, 2010, 2012, 2013, 2015 and 2016 recruited JTOs and JAOs. DIR(HR) is trying to meet the AS(T) tomorrow itself to discuss the matter. Taking their views also into account, the proposal will be sent to DoT. We are extremely thankful to DIR(HR), CMD and GM(Estt) for the prompt action to settle one of the heartburning issue.


Pay parity issue of Rs 22820 for the post 2007 batches: GS, CHQ President and Jt Sec discussed the pay parity issue of Rs 22820 for the 2007, 2008 and 2010 batch JTO/JAOs with CMD, DIR(HR), GM(Estt) and GM(SR) today and explained about the matter. We requested some immediate decision in this regard by referring the matter to a Committee for examination in a time bound manner. All of them responded very positively to the demand of the Recognised Representative Association for constitution of a committee to examine the issue.

Revised proposal on replacing intermediary pay scales of E1A and E2A by standard pay scales of E2 and E3 w.e.f 01.01.2007: As demanded by SNEA immediately after becoming Recognised Association, management moved a proposal very quickly to the MC of BSNL Board to modify their earlier proposal and limiting the proposal to E2 and E3, continuing with existing 5 promotions. Since the earlier proposal is having two parts recommending upgradation of all pay scales upto E7, DoT is not at all agreeing for that. Instead of approving even E2 and E3 scales, DoT is moving to Union Cabinet to approve E1A and E2A and the cabinet note is prepared. The immediate challenge is to stop the Cabinet memo for which intervention at higher level from BSNL is required.

The revised proposal is discussed in the MC meeting today itself. MC directed DIR(HR) to discuss the revised proposal with concerned officers (AS(T) and JS(A)) of DoT and get their views before approving and sending the revised proposal to DoT so that the revised proposal is accepted by the DoT.

If the management has shown this wisdom last time before approving the proposal for upgradation of all pay scales upto E7, issue would have settled long back.

GS and CHQ President met GM(CA) on 21.12.2016 and discussed the approval of the bylaws and Board of Trustees to manage the Superannuation fund by the BSNL Board. During discussion Association insisted that the money should be invested to the Fund Managers where maximum security is there from the Govt especially Sovereign Guarantee. The proposal was discussed in the last Board meeting but it was not concluded for some more clarity on certain points. We demanded early convening of Board meeting. BSNL is trying for an early Board meeting for the approval.

GS and CHQ President met Sr GM(Legal) on 21.12.2016 and discussed about the Term Insurance policy and Formation of Corpus fund for extending financial assistance to the employees in case of untimely death.

CHQ NEWS:
GS and CHQ President held discussions with GM(Estt) on sending revised proposal to DoT for replacing E1A and E2A by E2 and E3 alone.


JTO to SDE promotion case at Hon Ernakulum High Court: The case will be listed for final hearing in the end of first week of January, 2017 after Chritmas vacation from 21.12.16. The exact dates will be known today. In the last hearing, the case was delisted and it will be heard by the regular bench where the senior judge of the previous judge sitting now, instead of constituting the special bench.


GS, CHQ President and Jt Secretary continued the discussion on CPSU Hierarchy today with GM(Pers) and Jt GM(Pers) for more than two hours. Our demand to implement CPSU Hierarchy w.e.f 01.01.2017 is under active consideration. Discussions will continue. It is mutually agreed to complete the discussions latest by 15th January, 2017.
In addition to that the following issues also discussed:

a) Offtg pay protection: The final proposal will be submitted to DIR(HR) latest by 06.01.17.

b) JTO to SDE promotion under LDCE/Seniority quota, SDE to DE promotion and filing of SLPs in the Hon SC on all the three cases: Discussed the possibility of issuing LDCE promotion orders where the judgment on reservation and judgment on SDE RR amendment are the hindrances. SDE RR amendment and other HR issues are pending due to the insistence of BSNL Board for finalization of HR plan. For clearance of any proposal in the Board, HR plan is to be finalised. It has to be addressed on top priority. GS and President later on met Sr GM(Legal) and Company Secretary and held discussions on the pending points in the BSNL Board and HR plan. Other options like taking declarations etc under consideration if reservation issue can overcome.

The judgments on reservation issue in JTO to SDE promotion under LDCE/Seniority quota and SDE to DE promotion is the real issue for all the three promotions. Not only LDCE promotions, SDE to DE and JTO to SDE seniority promotions are also affected by these judgments. JAO to AO and AO to CAO promotion is also affected by the interim order on reservation. To overcome that, management is filing three separate SLPs in the three cases directly in the Supreme Court, bypassing the High Court to avoid the delay and get it tagged with other similar cases filed by other Departments on reservation issue. Discussions with the lawyer almost completed. Once SLP is admitted, the possibility of issuing promotion can be considered.

c) Request transfers in DE cadre: Due to pressure from CGMs and other corners on shortages, management was planning to consider the requests in a phased manner by March. Assn strongly protested and told that all of them are joined on the firm assurance of transfer after two years. They completed 2 years in Sept itself and due to MV the orders didn’t issued in October. After lot of discussions, it was assured to issue the transfer orders this month itself.



On E2, E3 issue CMD directed to send a DO letter to AS(T), DoT based on our letter with note sheet copies before the verification. The draft DO letter is put up for approval. After the verification the situation changed. Based on the clear stand taken by SNEA as the Recognized Assn and demand for replacement of E1A and E2A by E2 and E3 instead of sending E1A and E2A to Union Cabinet, management is processing to restrict the proposal to E2 and E3. We are working with management on this and management is very positive on this issue after verification.


GS and President met GM(Estt) and held further discussions on E2, E3 proposal and the DO letter. On pay parity of Rs 22820, we are trying to refer the matter to a committee. It has to be decided at higher level. Further discussions held on E1A and E2A w.e.f 01.10.2000 for C/E/Arch/TF and PA/PS cadres. Once the letter has gone to DoT on E2, E3 scales, further interactions on this issue has to be made.

Repeated failure of BNG resulting complete failure of BB network.
In eight days, it is the third time and last Saturday , BB was available for hardly one hour. So far it is not rectified. It is learnt that the N/w issue has coped up after the commissioning of new server at NOC Bangalore. Now some BNGs are re-parented to old server and found working OK.
This Association escalated the issues to CGMT and requested his urgent intervention in this matter. We also suggested him that an inquiry is to be made to study the frequent failure of BB.

CHQ NEWS dtd 16/12/16:
Discussion Started with Recognised Representative Association of Executives by Director(HR) on HR Issues:
GS and CHQ President met DIR(HR) and started discussions on the charter of demands on various issues. Further discussions will continue from monday onwards. As discussed with CMD on 14.12.16, the DO letter to DoT will be send early next week for approval of E2, E3 pay scales delinking it from the upgradation of other pay scales now. Discussions are started in a positive note and positive action from the management.
Immediately after verification, management started discussion with the Representative Association of Executives to settle the issues which is a good sign. Management agreed to take up E2, E3 now and upgradation of the remaining scales with 3rd PRC is the best possible solution now as we are demanding. This is the first breakthrough.

Comrades, due to demonetization, our business coming down sharply and every day business is down by 11.5 crores, monthly about 360 crores. If this trend continues for next 3 months, then revenue will be about 1200 crores less, a big setback to our 3rd PRC dreams. So do not waste a single moment and find new ways to improve the business and increase the revenue.

The required information in respect of all Officials in List-6 is already forwarded from Circle Office. It is reported that the information in respect of certain officers from List-7 is yet to reach the Circle Office.

Congratulations..!! to the valiant Comrades of Kannur.
The four Comrades from Kannur BA were transferred in 2014 based on longstay to other BAs deviating from the transfer policy 2008 of Kerala Circle by the then Circle Administration headed by Shri MSS.Rao. After long battles in Courts and samara pandal, these four officers were sent out from Kannur BA to Palghat and Calicut BA in Nov-2014. Transfer orders to these comrades back to Kannur released today. View Orders

Meeting with GM(HR & Admin) on 16/12/2016:

CS Com.Santhoshkumar, CT Com.Premkumar, ACS Com.Ramana, DS-CO Com.Suneer held a meeting with Shri Mohan.D, GM(HR&Admin) on 16/12/2016 for discussing pending HR issues. Shri Satheesh DGM(Admin) and Shri James Sagayaraj DGM(HR) also attended the meeting. The following issues were discussed.

1. Pending EPP cases: We reiterated the delay in issuing the orders regarding Time bound Financial upgradation. We expressed our concern over the long delay. Large numbers of cases are pending for more than two years. GM(HR) responded positively and assured for the early release of orders.

2. Group-C to JTO(T) LICE – filling up of vacant posts: We requested GM(HR) to fill up all vacant posts from among the candidates who have qualified in the LICE conducted against the year 2014-15 by carrying forward the unfilled vacancies of 2013-14 to 2014-15. It may be noted that more than 70% of JTO(T) posts of Kerala circle are lying vacant which is badly affecting the performance of the circle. In the LICE held for promotion from Group-C to JTO(T) for the vacancy year 2013-14, only 48 OC candidates were selected against the published total OC vacancies of 258. LICE was also conducted for the JTO vacancies against 2014-15 and as per the result published, only 8 JTO posts under OC category were announced whereas 181applicants have qualified in the test. We discussed the recent court judgement in this regard, wherein it was instructed by the CAT Ernakulam that applicants who desire needs to file a comprehensive representation before the CMD for considering their appointment as JTO for the vacancy year 2013-14. We raised our apprehension about the possible delay in processing the representation. GM(HR) stated that if the applicants are not willing to give comprehensive representation to CMD because of the possible delay in the process, they may be advised to submit separate undertaking to CGMT Kerala citing No Claim in 2013-14 vacancies. The Association will be further discussing the issue with CGMT in the next week for an early resolution.

3. Calling volunteers for DE(LA) in Iddukki district: We have pointed out that Officers are declining their DE(LA) promotions especially for difficult areas like Iddukki district. There is an acute shortage of Officers in STS cadre and moreover few Officers who are now working in Iddukki in STS cadre are waiting for relievers for going to their Home Circle – TamilNadu. In this scenario, we suggested GM(HR) to call for volunteers exclusively for Iddukki District instead of Ernakulam BA so that interested officers from any SSA can apply. GM(HR) responded positively.

4. Transfer cases of LICE JTOs who completed 2 years: There are around 60 LICE promoted JTOs who have completed two years’ service and are eagerly waiting to return to their Home SSA. We requested GM(HR) for considering the transfer requests of these officers. GM(HR) responded positively and informed that maximum individual cases will be considered based on merit in Jan-2017 and the remaining will be considered during the general transfer in Mar/April-2017.

During meeting, GM(HR) informed that there is a demand for posts in Term Cell, Ernakulam. Since Administration expressed constraints for posting executives in Ernakulam SSA, we suggest executives JTOs/SDEs working outside Ernakulam may opt for posting in Term Cell Ernakulam. The Administration agreed that if such requests are received for posting to Term Cell, it can be considered immediately.

5. Transfer cases of Kannur Comrades: Four officers from Kannur BA were transferred in 2014 based on longstay to other BAs deviating from the transfer policy 2008 of Kerala Circle by the then Circle Administration headed by Shri MSS.Rao. After long battles in Courts and samara pandal, these four officers were sent out from Kannur BA to Palghat and Calicut BA in Nov-2014. Now as these Officers have completed two years, we requested GM(HR) for considering the transfer requests of these officers to Kannur BA. GM(HR) informed that the orders are approved and will be released today itself.

CS writes to PGM(Finance) - Requesting for scheduling JAO Phase-II training for the last batch of 2013 LICE JAOs View Letter by CS to PGM(Finance)
This Association was continously persuing with the management to take necessary action for imparting phase-II training for JAOs. The matter was earlier referred to Corporate office by the Circle Administration and Corporate Office has instructed Circle to take necessary action in the matter as per Hon. CAT order dated 22-3-2016 in consultation with the standing counsel of BSNL under intimation to the Corporate office. Though the matter is pending since long and almost 2 months has elapsed after the instruction from Corporate office and the legal opinion from BSNL counsel, the training is not yet finalized. It may be noted that Order of the Hon CAT for appointment include necessary duties, training and salary attached to the post. As per JAO recruitment rule one JAO has to complete the phase-II and phase-III training within one year to earn his/ her increment. Since the officers are posted in the month of March 2016 we requested PGM(Finance) to take immediate necessary action for the training to the above officers.

We requested CGMT to fill up all vacant posts from among the candidates who have qualified in the LICE conducted against the year 2014-15 by carry forwarding the unfilled vacancies of 13-14 to 2014-15. It may be noted that more than 70% of JTO(T) posts of Kerala circle are lying vacant which is badly affecting the performance the circle.

After the meeting on Tower Subsidiary issue, we discussed other two cadre issues also with AS(T), DoT on 14.12.2016: All the GSs were present including GS/BSNLEU, AGS/NFTE, GS/ABSNLEA, GS/SEWA etc.

1) Sought his intervention to release the result of recently held JE examination. The results are withheld due to the intervention of DoT. AST is unaware of the issue and agreed to intervene in the matter.

2) Approval of E2 and E3 scales replacing E1A and E2A: AST informed that Govt cannot accept the proposal of upgradation of all the scales from E3 to E4, E4 to E5, ---- E6 to E7, E8 to E9 and E9 to E9A. So already directions are given to the concerned section to prepare a Cabinet Note proposing to approve revised E1A and E2A for the Executives already recruited in pre-revised E1A scale (9850-250-14600) and E1 and E2 scales for the Executives recruited later on (Accordingly JTO/JAOs recruited in 2007 and 2008 in E1A scale will get revised E1A scale and all the Executives recruited after that will be given E1 scale only). On our specific submission that SNEA demand is only E2 and E3, AST informed that there are Assns insisting for E3 to E4, E4 to E5 --- E6 to E7 which cannot be accepted by the Govt (eventhough recommended by BSNL). Further he mentioned that if they are not insisting for upgradation of remaining scales, then there is a possibility to consider E2, E3 alone. On this other Assn didn’t respond at all.

Afterwards GS and President met CMD and explained the developments in DoT. Now membership verification is over and SNEA granted the status of Recognised Association. As the Recognised Association in BSNL we demanded that E2, E3 proposal alone to be processed now keeping the other scales pending for 3rd PRC. CMD informed that management will go ahead with the opinion of the recognized Association in the future.

Comrades we are watching the developments closely for the next few days. Meanwhile the file proposal for holding meeting with Assn, BSNL and DoT on E2, E3 scales is under consideration in DoT. We are watching what stand AS(T) is taking on this issue. If positive developments are not coming from BSNL and DoT, we will go for direct trade union actions shortly as informed earlier.

One Day Stay out strike on 15.12.2016 (From 00.00 hrs on 15-12-2016 to 00.00 hrs on 16-12-2016) against Tower Subsidiary formation.
CHQ has requested all Circle Secretaries / SSA Secretaries / Activists to effectively organise the Strike in co-ordination with other Unions and Associations. Ensure 100% Participation.

Additional Secretary Telecom, DoT called a meeting of the Unions and Associations to discuss about the Strike notice against the proposed Tower Subsidiary formation. AST tried to explain the advantages of forming a Tower Subsidiary which all of us knowing. He failed to give any assurances on behalf of Govt that the Subsidiary will not be disinvested or go for a strategic sale in the future. Afterwards all the GSs met and unanimously decided to go ahead with the Strike from 00.00 Hrs of 15.12.2016.The Strike will be stay out Strike.

Congratulations..!! Corporate Office has issued Notification regarding Grant of status of Recognised Representative Association to SNEA. As per Rule 3(1) of Recognition Rules-2014, BSNL shall have only one representative Association of Executives which gets majority votes in the membership verification subject to a minimum of 35% membership of total votes of the working executives in BSNL. Accordingly SNEA, which secured majority votes and also more than 35% votes, shall be the Recognised Representative Association. Dear Comrades,

The first membership verification among the Executives Associations in BSNL is completed in a free and fair manner after 16 years of BSNL formation. From the very beginning itself attempts to derail the process through several court cases and other means were rampant. An element of risk in going through membership verification process also could not be discounted. But we could overcome all the hurdles with commitment and determination despite all confabulations, unholy congregations.

We made extensive tours during our campaign so that we could meet almost all Executives throughout the length and breadth of the country covering more than 300 SSAs out of 364 and gathered every bit of suggestions from them. This presented us an insight into the problems and challenges that our colleagues are facing, especially in North East, tenure, far flung, rural and interior areas, where they are really struggling to meet the challenges of day to day work. CHQ leaders, Circle and SSA Secretaries, office bearers/ activists/ supporters at various levels made the campaign very successful reaching out to each and every Executive, personally. Attempts from a section of the people to malign our Association which has always stood for the dual goals of upliftment of the cadre and for the viability of BSNL, was far from few and rare. They charged the SNEA for all the unsettled issues and in the process, did not hesitate to align with the Management, thereby scuttling several issues of vital importance to the cadre. But this was nothing but a clear admission by them that only SNEA was, is and will be capable of settling any issue including the complex HR issues. Our committed members stood like a rock against the wave of mal propagandas and finally won the war. We thank and reciprocate each and every comrade who put their wholehearted trust in us all along, particularly in this bitterly fought battle.

Now the election is over. The Executives in BSNL voted SNEA over others to the role of the Recognised Majority Association. Comrades, we have proved it again. History is on our side with this Association carrying out the huge responsibility all throughout the last 3 decades, never failing the cadres and many times even exceeding their expectations. We are aware that once again we have been voted and reposed with this immense responsibility. We shall fail none including those that might have voted against us. It is incumbent on us to take everyone into our fold and fulfil their dreams as only this great organization can do. We are once again reaching out to those that chose to be not with us. You are all welcome to build this organization, build the future of the cadres without distinction, build a vibrant BSNL. In the coming days our focus will be to address all the issues and prove that those who made malpropaganda against SNEA are wrong. We cannot and will not rest on the laurels of a great victory but continue more vigorously till we attain the goals.

We know that verification is only the first step to settle the HR issues; many many more miles to go. But remember we shall not rest or relax. History reminds us that many challenges are awaiting us. Let this mandate be the source of powerful energy for all of us to face such challenges ahead. Our commitment to the Executives is that SNEA will work for the best interests of the cadre, none excluded. Challenges are many. E2, E3 pay scales before 3rd PRC, CPSU cadre Hierarchy upto AGM equivalent grade to end the stalemate in Functional promotions, 30% Superannuation benefits with Term Insurance/Corpus Fund as Social security, pay parity of Rs 22820, implementation of 3rd PRC and upgradation of remaining scales upto E7, JTO to SDE promotion under seniority and LDCE quota, SDE to DE/EE and DE to DGM promotions, JAO to AO and AO to CAO promotions, first TBP after 4 to 5 years, E1A and E2A scales notionally from 01.10.2000 for Civil/Elect/PA/PS/Arch/TF cadres, Rule 8 cases, increasing the number of DGM posts etc are the immediate challenges and issues to be settled. Above all we have to take our company back to its glory, protecting it from vested interests.

Transfer of JAOs in Thrissur on the eve of Referendum:
As we were apprehended and reported earlier, officers of Finance wing belonging to AIBSNLEA are misusing their positions to take vindictive and discriminative actions against SNEA members of Finance fraternity. Today, on the eve of referendum and after the office hours, an order was issued in Thrissur SSA transferring two of SNEA members (JAOs) out of SSA HQs to far off places without any rhyme or reason.

SNEA strongly protested against this order and requested PGM Thrissur to cancel the order with immediate effect. Based on our protest and request, PGMT Thrissur has ordered to keep this order under abeyance till further orders. We thank PGMT Thrissur for honouring our protest and request.

Dear comrades, we will not allow any kind of highhandedness or vindictive actions against our members. We will not leave this issue until a decision is arrived till everyone’s satisfaction.

Reply to the CHQ site of Consistent and Persistent group:
The whole BSNL fraternity knows, which associations were supporting MSS.Rao in 2014 and 2015 when SNEA Bravehearts were fighting against the mighty administration for reinstating the legitimate rights of Employees.

How can we forget the day when both AIBSNLEA and AIGETOA held press conference in support of MSS.Rao on 30/7/2014. How can we forgot those days when both these associations were impleading in CAT-Ernakulam for reinstating the corrupt and autocratic MSS.Rao as CGMT Kerala, who eventually exited BSNL without any pensionary benefits (due to his chargesheets filed by CBI for the misconducts done by him as GM, Corporate Office and also as CGMT Kerala). It is an irony that AIBSNLEA CHQ is not aware of this. What a Joke..!! Whom they are fooling..!!





Our executives were harassed in the name of meetings and webinars, DGMs of various SSAs were called to Circle Office only to get harassed as Worst DGMs. Our mobile DATA connection was withdrawn, our residential phones were disconnected. Without considering terrain and geographical conditions, subdivisions and divisions were reorganized. Without following any norms, executives were transferred by pick and choose policy.

There was a transfer policy followed in Kerala Circle, agreed in 2008 by SNEA and AIBSNLEA for the smooth functioning of Kerala Circle. The Corrupt and Autocratic CGM deviated from this 2008 transfer policy and declared that there is no Home-SSA concept as JTOs are Circle cadre and SDEs are All India Cadre.

It all started when SNEA questioned the intention of CGMT in the constitution of a committee to revise decision of the competent authority after due examination for imposing a penalty of Rs32 Crores against the vendor Nortel for not complying with PO conditions. We were very sure about the intention of CGMT behind the reconstitution of committee.

As a responsible association we went for agitation and struggled against dismantling of the healthy mechanisms prevailing in Kerala, against corruption, against nepotism, against autocratic administration for the legitimate rights of BSNL fraternity and to reinstate the transfer policy for bringing back the executives (irrespective of association) to their Home-SSA.

In the sustained struggle we faced various dies-nons, chargesheets, police cases, court cases, vindictive transfers, and what not. But we were always confident that Truth will always Triumph. Fearlessly we went ahead and as you all know, the corrupt officer was forced to retire as Principal, RTTC. This struggle exposed those who acted as agents of corrupt elements, having no trade union ethics.

Finally when all our legitimate rights were reinstated by the new administration, the Consistent and Persistent group emerged with claims.


Dear Comrades, SNEA is the only Executive Association that can fight with Management for all our rights and also for the growth of our Company.

Circle Office issued Guidelines for Identity Card for Membership Verification

It has come to our notice that the demand of SNEA to evolve a transparent Transfer/Postings Policy for Accounts, Civil, Electrical etc to avoid uncertainty and misuse either by the Leaders or by the Administration is being criticised by vested groups who were continously misusing their position.
We once again assure all Executives that SNEA is against "Transfer for the sake of Transfer", and our demand is in case of any transfer becomes inevitable, it should be based on a transparent mechanism which will enable the executives to have proper advance information.

During the MV campaign by the Circle and SSA leaders in all SSAs, Officers belonging to Accounts, Civil, Electrical etc gave a warm response to SNEA. They expressed their frustration and anguish over the failure of legacy unions which claim total representation of these streams viz.

1. There is no transparent and systematic Transfer/Postings policy in Accounts wing as available in Telecom engineering wing. The demand of SNEA for publishing the stay particulars of officers of Accounts wing was criticized by AIBSNLEA. Once stay particulars are published, it will become transparent and the Leaders/Administration will not be able to manipulate according to their personal choice. There are instances where Finance officers who are returned even from Circles like Gujrat are not posted to their Home SSA, while some Leaders (even on their promotions) are able to get re-allotment to Home Circle and posting in Home SSA without any criteria.

2. JTO/JAO’s recruited post 2007 were very much critical about the stand taken by the associations other than SNEA with respect to the Standard Pay scales of E2-E3 by demanding CASCADING payscale revision which ultimately resulted in the rejection of basic demand of E2 and E3, resulting huge loss to these officers to the extent of Rs5000 to Rs10000 per month.

3. While 75% of STS(Telecom) posts are filled under seniority quota on regular basis, the Accounts STS posts are filled only to the extent of 50%.

4. Promotions in Executive Engineer grade in Civil/Electrical/Architecture are only 50% and discriminated w.r.t B.Tech/Diploma

5. Civil/Electrical PA/PS etc not got E1A scale from 1.10.2000

SNEA assure all executives after 7/12/2016, there will be only one Executive Association to represent the Executives, SNEA will ensure parity and justice to all executives without any discrimination.

Hundreds of similar emails are being received daily by almost all Office Bearers of CHQ/Circle/SSA, for the last few days from post 2007 JTO/JAOs especially 2007 and 2008 batches requesting immediate approval of E2, E3 pay scales delinking the upgardation of other pay scales. Due to the proposal of upgaradtion of all the scales, all are under the threat of rejection of even genuine E2 and E3 pay scales due for them. It is the truth revealed by the DoT Note sheet. This may be treated as a common reply to all the emails :

Comrades, SNEA is pursuing this issue with top most priority. General Secretary cancelled all the tour programmes and stationed at New Delhi for the last few days and continuously pursuing it with DoT and BSNL management. No other Assn taken these developments seriously and pursuing with DoT/BSNL.

GS met Jt Sec(A)/DOT and discussed the issue in details on 30.11.16. Finally Jt Sec(A) agreed to conduct a meeting of DoT, BSNL and the Assn after one week, ie 3rd week of December to sort out the issues and find out a workable solution. It is a very positive development as we could stop the rejection of the E2, E3 pay scales once again.

Then GS met CMD/BSNL on the same day and further discussed the issue and demanded that E2, E3 pay scales should be settled immediately. CMD assured that BSNL will first get the E2, E3 pay scales approved before 3rd PRC and upgradation of remaining scales will be considered during 3rd PRC implementation. CMD given necessary direction to DIR(HR) also in this regard. We are pursuing with DIR(HR) also further.

SNEA already decided to launch agitation if BSNL management is not seriously taking up this issue with DoT and settling it immediately. We are just watching the developments for another few days.

Comrades, Be United, we can face any challenge. SNEA will not allow the demotion of the basic cadres to E1 and E2 scales. Strengthen the hands of SNEA by voting to Sl No 9. This association has taken up the issue with Administration for the postponement of the trainings scheduled at RTTC-Trivandrum during the Membership Verification process.

GM(HR) has responded and informed our CS:
"S&M Module(E-tendering through ERP) training 6th 8th of December, Executives nominated/ being nominated may be permitted to withdraw their nomination for training programme in view of ensuing 1st membership verification election scheduled on 7th. However those from Trivandrum BA, Civil, Electrical and other BAs may attend the training. After the training by ALTTC faculty training will be conducted by RTTC Subsequently - GM(HR)"

Meeting with Sri Anupam Shrivatava, CMD, BSNL on replacement of intermediary pay scales of E1A and E2A by standard pay scales of E2, E3:

After meeting Jt Sec(A)/DoT on 30.11.2016, GS and AGS met CMD BSNL on the same issue and explained him about the developments in DoT where senior officers in DoT like Addl Secretary(T) recommended to refer the E1A and E2A scales to Union Cabinet or extend E1 and E2 pay scales for the fresh recruits (Same thing available in the note sheet uploaded earlier in our website which other Assns suppressed due to obvious reasons).

The BSNL proposal complicated the whole issue as DoT is not accepting the proposal to upgrade all the pay scales citing huge financial implication and pension liability. Due to this the legitimate demand of E2, E3 from 01.01.2007 also getting rejected by DoT.

Assn informed CMD that in that case Assn is going to launch agitation without any further notice as communicated on 28.11.16. Huge industrial unrest will happen and BSNL management will be squarely responsible. BSNL only can save the demand of E2 and E3 by delinking it from the upgradation of all other pay scales for the time being and get the E2, E3 approved before 3rd PRC. Remaining scales upgardation can be taken up during 3rd PRC implementation from 01.01.2017, after one month.

Finally CMD assured that BSNL will first get the E2, E3 scales approved before 3rd PRC and upgradation of remaining scales will be considered during 3rd PRC implementation. This is the best possible solution.

Meeting with Sri Amit Yadav, Jt Secretary(A) and Rajiv Shrivastava, Director(TPF), DoT on replacement of intermediary pay scales of E1A and E2A by standard pay scales of E2, E3:

GS and AGS met JS(A) and had heated arguments on the proposed move of DoT to down grade the pay scales of JTO/JAO from E1A to E1 and E2A to E2 or to send E1A and E2A proposal to Union cabinet for approval. Addl Secretary(T) has recommended for this and DoT is planning to communicate it to BSNL. Director(TPF) informed that since nodal cell of DoT is not recommending the proposal, DoT(Fin) is having no more role to play. The proposal is already turned down by DoT earlier also.

JS(A) told that DoT is of the view that due to the huge financial implication on DoT in terms of future pension liability and for BSNL in terms of pay and perks, BSNL proposal cannot be approved. For each employee, financial implications for 35 to 37 years of service are to be calculated and then the pension liability on DoT for another 15 years. This has not done by BSNL. If BSNL is competent to decide the pay scales by its own, it can do so. BSNL proposes the upgradation not only for two pay scales but for all the pay scales. BSNL is making huge loses and according to DoT, BSNL cannot afford such revision of pay scales in long term.

Association countered the arguments of JS(A) one by one:

A) It is the Union Cabinet decision to implement standard pay scales as per of 2nd PRC recommendations. The cabinet decision has come as DPE order. Further DPE again communicated to DOT in 2014 that intermediary pay scales of E1A and E2A cannot be approved and standard pay scales are to be implemented. So, the AS(T) proposal of sending E1A and E2A pay scales to Union Cabinet for approval devoid of merits. Even DPE will not give concurrence to such proposal.

B) The AS(T) suggestion that it can be treated as a pay anomaly and can be compensated by giving additional pay in E1 scale is not correct as the issue is of the revised pay scales of E1A and E2A after 2nd PRC. The revised standard pay scales are to be notified w.e.f 01.01.2007. It cannot be treated as a pay anomaly issue at all.

C) The BSNL proposal cannot be dealt by 3rd PRC as suggested by DoT earlier. 3rd PRC deals with pay revision from 01.01.2017. The present case is revision of pay scales from 01.01.2007 as per 2nd PRC.

D) DoT cannot take unilateral decisions on pay scales. The pay scales are to be approved by Administrative Ministry as per the recommendations of BSNL only, this is the Cabinet decision.

E) DoT should allow BSNL management to run the company and decide the pay scales etc. On this JS(A) told that on operations matters, DoT will not interfere but on pay scales, Govt approval is mandatory as it is having financial implications on Govt and on the health of the CPSU. BSNL and MTNL are the two unique CPSUs where Govt pension is extended.

F) Almost 80% of the Executives recruited by BSNL after 01.01.2007 are not having pension, they are BSNL directly recruited employees. Remaining 20% is having only few years of service left and the financial implications for them is minimum. On this JS(A) commented that these facts are not mentioned in BSNL proposal.

G) According to BSNL, total financial implications per year from 2015-16 will be about Rs 46 Cr only. It is not a big amount which BSNL cannot afford. In earlier years, it will be much less. BSNL is ready to make the payment.

H) Even after implementation of E2 scale, the basic pay will be much less than that of the pay fixed for the Executives joined earlier. Minimum of E2 scales is Rs 20600 and pay fixed on pay revision on E1A scale is Rs 22820.

I) The demand from the Assn is the replacement of the intermediary pay scales of E1A and E2A by standard pay scales of E2 and E3. Part I of the BSNL proposal is the same. Upgradation of other pay scales is the proposal of BSNL. The justification and alternative to this 2nd part can be discussed with BSNL. Pay scales and five TB promotions are part of the terms and conditions of absorption. Any solution on the 2nd part without deviating from the basic principles of terms and conditions for absorption and EPP is acceptable for the Assn.

J) In the name of upgradation of other pay scales, the basic issue of revision of pay scales of E1A and E2A with standard pay scales of E2 and E3 cannot be rejected. The cadres cannot be down grades and the existing pay scales cannot be downgraded.

Finally after lot of arguments, JA(A) agreed to hold a combined meeting of the Assn, BSNL and DoT officers after one week to find out a workable solution.

Comrades, THE FIGHT IS STILL ON ---. Atleast we could save the proposal for the time being. We should mount lot of pressure on BSNL management and DoT in the coming days, atleast to get the upgradation of the pay scales of the basic cadres of JTO/JAO and SDE/AO to E2 and E3 and protect the cadres from demotion by down grading the pay scales to E1 and E2.

Now Suddenly Some Associations realised that Home SSA concept exists - may be due to MV Fever...!!!
Nowadays, some associations are busy with ensuring executives about their transfer cases, but earlier when their favourite CGM declared “There is no concept of home SSA for executives in BSNL. JTO’s are Circle cadre, SDE’s and above are All India cadre” (See letter from Administration), the same association kept mum on the letter and praised the then CGMT by holding press conferences and knocking the door of various courts for the continuation of the CGMT but today they suddenly realized about the home SSA concept when Membership Verification is going to take place.
We have not forgotten the Press conference done by AIBSNLEA & AIGETOA on 30/7/2014 against the genuine expectations of Executives which they lately realised now during Membership Verification.

SNEA fought and struggled relentlessly to ensure the legitimate expectations of the executives for transfer back to their home SSA by undergoing all types of vindictive action like dies-nons, second medical opinions, charge sheets, punishments, criminal cases, defamation cases etc. In this year alone 255 such transfer requests were approved which were denied by earlier Circle administration with the active support of the so called MOU partners.
Once again we assure all executives in Kerala Circle the transfer requests of all those who completed 2 years will be materialized without undue delay.

GS writes to DIR HR regarding Pay parity of 2007 and 2008 batch JTOs at par with the 2005 batch JTOs joined after 01.01.2007 and the 2010 batch JAOs who got fixed at Rs 22820/-. Further requests to constitute a committee to examine the case as done in the case of JAO 2010 batch. This will address the grievances of the TTAs become JTOs as departmental outsider in 2007 and 2008 batches. They are facing similar pay loss and even those could not become JTOs and continued as TTAs and become JTOs in 2013 through LICE are drawing higher pay than those become JTOs in 2007 and 2008.

GS writes to CMD, BSNL --- Immediate intervention to stop the demotion of the basic cadres of JTO/JAO and SDE/AO from E1A scale to E1 and E2A scale to E2 -- BSNL proposal in two parts creating problems in DoT which has to be cleared by BSNL management to save the proposal.
The DoT note sheet on the proposal clearly establishes the fact that the second part of the BSNL proposal to upgrade all the pay scales upto E7 is opposed by DoT, resulting into the rejection of even E2, E3 pay scales proposal in the first part. Any attempt to demote the cadres and denying the legitimate pay scales of E2, E3 will lead to industrial turmoil in the company. This may be treated as an advance trade union notice.

CHQ President and AGS met CMD BSNL on 28.11.2016 and explained in detail about the status of E1A to E2 & E2A to E3 at DOT. We requested his immediate intervention as mentioned in our letter addressed by GS for resolving the issue on priority. CMD once again assured that it was his commitment to get the concurrence from DOT for the upgradation of Pay Scales from E1A to E2 & E2A to E3.

Developments on standard pay scales of E2 and E3 replacing the intermediary pay scales of E1A and E2A:
Addl Secretary (Telecom) has returned the file, back to Member(Fin) with some adverse comments even on replacement of E1A and E2A scales with E2 and E3.

The BSNL proposal in two parts is
1) replacement of E1A and E2A pay scales by E2 and E3 and
2) further upgardation of all the pay scales upto E7.

DoT Finance justifying the upgradation of E1A to E2 and E2A to E3 but the proposal for upgradation of all the pay scales from E3 to E4, E4 to E5, E5 to E6 and E6 to E7 is not supporting, citing huge financial implication on pension. This is becoming the stumbling block as we suspected. The nodal PSU section is not supporting the proposal at all. AST recommended replacing E1A with E1 scale and E2A with E2 scale for the new recruits.

Demand of SNEA on this issue is very clear from the note sheet itself (read page 1, 11 and 23 carefully. Page 23 reveals the actual stumbling block which was hiding while circulation in the WhatsApp).
It is a dangerous move and we have to respond organizationally, immediately once the membership verification is completed. We alerted CMD/BSNL about this developments and closely watching initiative from CMD.

The CAT is out of Bag.......
The 24 page detail note sheets from DOT, clearly indicate the stand of associations, the inputs given by them for the resolutions and the real stumbling block for its implementation. Read carefully page-1, page-11 and page-23. A part of page-23 was purposely hidden by Shri Goutham, the actual recipient through RTI. As rightly pointed out by the recipients (Shri Gowtham) - once it is revealed before referendum, it will change the gameplan. The page-1 of the notesheept begins with the introduction of the subject quoting Sanchar Nigam Executives association. In its entire 24 page notesheet, AIBSNLEA could not find a mention on the subject. Page-11 clearly shows the valuable suggestions given by SNEA for accepting the demand of E2-E3 in place of intermediary pay scales of E1A and E2A. Page-23 clearly reveal the stumbling block that the ambiguity is regard to upgradation of payscale from E3 to E6 is the main reason for returning the proposal of BSNL for revision of E1A to E2 and E2A to E3.

against formation of Subsidiary Tower Company was a massive success:

The dharna, called on by the unions and associations of BSNL, against the formation of Subsidiary Tower Company on 25/11/16, was a massive success. The Non-Executives and Executives of BSNL throughout the country have participated in large numbers in the dharna. All the leaders declared that the one day strike on 15.12.2016 will also be a total success.
All the attempts by Government to disinvest BSNL has been stopped by the united struggle by all the Associations and Unions. When Govt failed to disinvest BSNL, this is a tacit move to make BSNL into small Subsidiaries and then disinvest the Subsidiary. If we allow Tower Subsidiary formation today, Govt will march ahead with Subsidiaries for Land monetization, Subsidiary for OF network etc. Already Govt formed BBNL to weeken BSNL. It will be very easy for the Govt to disinvest such small Subsidiaries rather than disinvesting gigantic BSNL. Ultimately all revenue earning and potential segments will be out of BSNL.

One Day Dharna on 25th Nov 2016
against the Govt move for separate Tower Subsidiary formation:

All District Secretaries are requested to make extensive preparations incoordination with all the unions and associations for the one day dharna on 25/11/2016.
All Union / Association meeting held at New Delhi on 16-11-2016, unanimously decided to conduct Dharna on 25-11-16 and one day strike on 15.12.2016, against the proposed move for formation of Subsidiary Tower Company. This is another move for disinvestment by making BSNL into small pieces. In the past, the united BSNL trade union movement has foiled all attempts of the government to disinvest BSNL. Once again we will prove that we will not allow BSNL to be destroyed.

Irregularities in JAO Posting:
The association has strongly protested the posting against not accommodating the first rank holder (in LICE as well as in JAO training) in Thrissur BA and posted him to Kannur and another person was posted to Thrissur BA without any norms. The matter was discussed with PGM(F) and it was told that the criteria applied was the age. We are surprised to hear that age of 42 years deserve a consideration in posting while officers of even 56 years are posted to Kannur BA from Ernakulam.
We strongly demanded to review the case and post the first rank holder at Thrissur. PGM(F) expressed his difficulty to review this case alone which may lead to demand for change in many other places also. SNEA cannot accept this aberration and demanded PGM(F) to set right this injustice. We will continue our effort to rectify this anomaly at the earliest available opportunity.
Dear comrades, have confidence in our strength, we have surpassed many difficult situations and we are confident we will be able to rectify this kind of injustice to our members.

Congratulations! On our continuous persuasion and repeated requests with the BSNL Management, the competent authority approved for issuing Promotion order to the successful candidates of JAO LICE (40% Quota) held on 17-07-2016 and successfully completing Phase I induction training at various training centres throughout India. CHQ President and AGS met GM(Recruitment), GM(Pers), GM(SR) on the issue of instructions from Corporate Office to CGMs not to give posting orders to the JAO trainees after the completion of training on 18.11.2016. We were informed that this was done because there were some discrepancies in Questions and those have to be evaluated by a committee. We vehemently opposed the move of the department for not promoting these officers to the rank of JAO as they have successfully completed the required training throughout India. In this direction a letter was also written to Director(HR).
We have come to know that on our pleadings a note has been prepared by the SEA section and is sent to the recruitment cell for giving promotion to JAOs. Orders are expected very shortly.

Now they are claiming amendments to JTO-RR, sending them for training as achievement....

After 7 years of consistent and persistent legal research they realized that amendment to JTORR 2001 was the only way out for the regularization of Offg JTOs which was proposed by SNEA since 2007. Sweet Lies never withstand, but Bitter truths. Practical Solutions are coming only from Matured and experienced Leaderships who really want solutions to issues rather than not to fish from the troubled water.
Affected people may not like the bitter truth at once, but it was the truth which survived and what SNEA told in 2007 has finally came out as practical and logical solution – Amendment of JTO RR for regularizing JTO Offg.

After the court order against regularization of offg JTOs by post diversion it was known to every one having common sense that the only valid way out is the Amendment of the JTO RR2001 .

But, then why AIBSNLEA mislead these officers for years ???
AIBSNLEA was not having any intake and senior members were retiring and new executives are joining SNEA or AIGETOA. The only left out was this group who were facing deep crisis in their career and tried to fish from the troubled waters by disguising as savior of JTO Officiating by giving false promises.

Unwavering stand of SNEA : Then and Now, SNEA has only one stand and we never changed, because we know what are the practical and legal solutions for the cases. We never offered a regularization as per JTO RR 2001 to those JTOs since there were no clause in that RR, Hence any regularization as per RR 2001 might be questioned legally and might affect the process stand still and hence we suggested and tried to get amendment in JTO RR. We never offered any prior seniority since it was not legally viable and may affect the entire career progression of these officers. We are not a Website Association, from the experience and common sense we are giving practical solutions to accommodate all category officers in a single platform.
Even one month of seniority is very crucial in BSNL now, then just imagine the officers who lost almost 7 years in their career simply misled by an Association who self proclaimed as consistent and persistent. Affected Officers lost their 7 years of services as JTO, Pay, Increments and Time Bound Promotions.... Only because of deliberate manipulations.

Any Follow-up on those assurances by AIBSNLEA ???
They finally thanked and congratulated the very same officers for the promulgation of JTORR against whom they demanded vigilance enquiry for not regularizing offg JTOs under existing RR.

But now they have another MOU partner, forgetting votes and they have forgotten old slogans on right to become JTO under old JTO-RR and seniority prior to 2000.
They are silent on the argument of the new MOU partner that "JTOs regularized by creating 3500 supernumerary post are not eligible to be included in the JTO eligibility list for SDE promotion".

It is quite natural that when one is on new honeymoon mood......
they don’t like to remember the story of old partner.

Anyway it is clear that so called Consistent and Persistent Association is not consistent in their Offers to JTOs officiated for a long time after getting the new young partner as affiliate. Separate secret meetings in different places are held by these consistent and persistent Association for JTOs who already officiated and then with new partner. In one side they are offering seniority of Officiating period of JTOs (even after 7 years of cheating and misleading, they are again coming out with old wines in new bottles), and in the other side they are supporting the cases by their young partner to sabotage the entire career of JTOs qualified through screening test and promoted for one time as JTOs in Supernumerary posts.

Appointment of JAO trainees on completion of training:
The Corporate Office has issued instructions to CGMs not to give posting orders to the JAO trainees after the completion of training on 18.11.2016. As per the direction of DIR(HR), GS, AGS and Jt Sec met GM(SR) and explained the issue in detail. DIR(HR) has to attend some meeting outside BSNLCO. Since the final results are published after considering all the discrepancies and training is already completed, Association demanded that posting orders are to be issued immediately without delay. Further there are sufficient vacancies in almost all the Circles to accommodate more JAOs in case more candidates are passing the LICE. So there is no need to keep the appointment pending, Association explained. We are interacting with GM(Rect) and GM(FP) also on this issue to find an immediate solution.

Congratulations..!! Due to our continuous pursuing at Circle Office and at NATFM-Hyderabad, Phase-II training (4 weeks) of 2015 batch DR-JAO's is rescheduled from NATFM-Hyd to RTTC-Trivandrum and will start from 28-11-2016. We thank PGM(F) and his team for responding positively and considering our requests/suggestions. We also thank our CHQ leaders for their continuous pursuing at NATFM.

Sad News:
Sri Vinodkumar, SDE Thiruvankulam (Ernakulam SSA) expired at Amritha Hospital at 11 AM today. Body will be brought at BSNL Bhavan, Ernakulam by 2PM for paying last respects. Body will be at residence Tripunithura Puthiyakav. Cremation will be on 17-11-2016 at 10AM. SNEA Kerala Circle conveys its deepest condolences to the bereaved members of his family for this greatest loss.

CS writes to PGM(Finance) regarding scheduling JAO Phase-II training at RTTC-Trivandrum for the last batch of 2013 LICE JAOs and few other left over cases.:

We express our sincere thanks for the positive steps taken by Circle Administration for clearing all the hurdles in imparting Phase-II training to the last batch of 2013 LICE JAOs. It is understood that circle office has addressed NATFM for imparting the Phase-II training to these JAOs. In the meantime NATFM-Hyderabad has now published Phase –II training schedule for 2015 batch Direct Recruit JAOs starting from 28/11/2016 for five JAOs of Kerala Circle. In this connection it was informed that one of the above JAO is handicapped lady officer and another officer has requested for training at Trivandrum due to her domestic compulsion.
Considering the above, if Phase-II JAO training is arranged at RTTC-Trivandrum, we will be able to curtail the expenditure on Travelling Allowances as well as inconvenience for the trainees.
It is understood that NATFM may consider allotting batches at RTTC-Trivandrum if such proposals are made from Kerala Circle. So we requested PGM(F) to take up this matter with NATFM requesting to allot batches (Direct Recruits – 5 nos and Promotion Quota – 32 nos) at RTTC Trivandrum. Ongoing JAO Phase-1 training will be over by 19/11/2016 and hence RTTC Trivandrum will be able to conduct these batches. Moreover since the Membership Verification is scheduled on 7/12/2016, the deputation of the officers to outside the Circle will create administrative difficulties in Membership Verification.

CS writes to PGM(Finance) regarding posting of LICE JAO's:

The ongoing JAO training will be completed on 19-11-2016 and it is learnt that sufficient vacancies are available at most of the SSA’s to accommodate the JAO’s who are completing their training on 19-11-2016 except Ernakulam and Trichur SSA’s.
It is understood that vacancies for filling up is decided based on the working strength with respect to sanctioned strength based on old norms. In fact the old norms does not account the present day working of Accounts’ wing like marketing, CSCs, OSP, CRC, TR collections etc. In this context we requested administration to consider the revenue earnings of SSAs like Ernakulam also while filling up the posts. Considering the revenue earning capacity of both SSA’s EKM and TCR , the vacancies at both SSA’s can be increased thereby we can minimize the inconvenience to the officials as most of them are having children of very low age. We are hopeful that our suggestion will be considered so as to boost the morale of the Officers who are entering in to the executive community.

GS writes to CMD for replacing GSLI Scheme with Term Insurance for BSNL recruited Employees:

At present GSLI scheme is in operation in BSNL for all Employees i.e. (1) Recruited by DoT and Absorbed in BSNL and (2) Employees recruited directly by BSNL. For Employees of category (1), family pension is paid by Government in case of any unfortunate incident happens. While for employees at category (2), their family gets EPF, gratuity and other benefits which all combined together is very small amount for survival of the family members for rest of the life.

Now Super Annuation Benefit @ 3% is approved by DoT and we understand that BSNL will finalize the modalities quickly. But there is a shortcoming i.e. eligibility of pension / family pension is after 15 years only, so in case of any unfortunate incident within 15 years of becoming member of the Pension fund, his / her family will not be eligible for any family pension and will be in pitiable condition. In this regard, to give a good family support, our suggestion is as below.

Present GSLI scheme give insurance benefit of Rs. 3 lakhs to JAO / JTO / JE with Rs.315/- per month as premium. Small amount is going to contribution which is paid at the time of retirement which is very meager. If a Term insurance of LIC for Rs. 25 lakhs is taken, annual premium will be about Rs.6,000/- (Considering average age as 35 yrs. for BSNL recruited Employees). If BSNL purchases the Term plan for say all Category (2) Employees, minimum 25-30% Discount will be given and the amount of premium will be near to the monthly deduction taking place for GSLIS.

SNEA requested CMD to bestow his personal attention and instruct the concerned officers to finalize the scheme replacing GSLIS for the BSNL directly recruited employees which is need of the hour as far as social security of Employees recruited by BSNL is concerned.

BSNL Kerala agreed to accept currency notes Rs500/- and Rs1000/- for the CSC transactions: SNEA Kerala took the issue of liquidity crunch with CGM and PGM(F) and suggested to accept 500/1000 notes in all Counters till this month end. We should capitalise this opportunity as we can collect all oustanding dues within this month. Assam CGM implemented this. We requested to consider the suggestion and a quick decision is to be made in this regard.
PGM(Finance) responded positively to the suggestion and informed that he has instructed all IFAs to further instruct the CSCs to accept old ceased 500/1000 notes.... ONLY for today, No deposit will be accepted.

SNEA arranged a welcome gathering for the JTO/JAO induction trainees whose Phase-I training commenced recently at RTTC Trivandrum and greeted them on their selection and heartily welcomed all to the executive community. Branch Secretary Com. Maheshwaran Nair introduced all Circle & District Office bearers present during the occasion to the trainees and offered unconditional support from SNEA to all in making positive contributions to our beloved company BSNL.
Leaders reminded the gathering that SNEA has always been the binding and driving force of Executive-Non Executive unity and joint struggle in all policy based issues either of the government or of the Company and reiterated our commitment to safeguard the best interests of all employees of BSNL in general and Executives in particular. SNEA is fully committed to the growth of the company and the career progression of the Executives. Leaders also mentioned about the achievements of Executives in the past in all those fronts due to sustained struggle by SNEA and its role in ensuring the best packages of Pay, Pension & Promotion especially with regard to our ongoing struggle for the implementation of 3rd PRC, Standard pay scales, Superannuation benefits and Time bound functional promotions.

Meeting with PGM(Finance) on 9/11/2016:
Circle President Com George Varghese, Circle Secretary Com Santhosh Kumar, Assistant Circle Secretary Com J.V.Ramana, District Secretary Circle Office Com Suneer.S met PGM(Finance) on 9/11/2016 and discussed the following issues:
1. Withdrawal of legal tender Rs500/- and Rs1000/- currency notes and its effect on our CSC: Association suggested for taking necessary precautions so that our services are not withdrawn due to nonpayment, till the present crisis of currency due to demonetization ends. The pay by date are to be shifted accordingly if necessary. PGM(F) informed that there is no pay by date in this week and we will monitor the situation as and when arises.
2. JAO Postings: We have discussed the JAO postings and expressed our views. According to the present vacancy position reported, officials from all SSAs except Ernakulam and Thrissur will be able to accommodate in the same SSA. We requested to review the vacancy positions of Ernakulam and Thrissur SSA as officials from these places are under training. PGM informed that the vacancies are taken into account from the percentage of working wrt sanctioned strength. We have pointed out that the old sanctioned norms does not reflect the present working strength as role of Accounts officers in marketing, CSC, CRC, TR collections, OSP etc has evolved in the present competitive scenario. Similarly the revenue contribution of the SSA’s also to be taken into account while considering the filling of posts. We have presented the revenue collection of Ernakulam SSA of 500 Cr (out of total 2650 Cr from all SSAs) which justifies 20% of JAOs of the total strength which comes to 65 whereas the sanctioned strength as per old norms is only 49 and present working strength is only 42.
We have also pointed out that most of these officials are Junior Engineers, and the work of JAO will be new to them and they will be able to give better output by posting them in their home SSA’s particularly considering the fact that most of their children are at very low age and it will be very difficult for them to leave their family at this juncture. We requested PGM to consider all these aspects while finalizing the postings. PGM agreed to look into the points brought out by the Association also while finalizing the postings.

Meeting with DGM(HR) on 9/11/2016:
1. Relieving of Officers (DE cadre to their Home Circle) and status of DE(LA): We met DGM(HR) and enquired about the status of DE(LA) cases as in some places relieving of transferred DE’s is delayed for the want of substitute. We are informed that there are options already available from SSAs - Thrissur, Ernakulam, Trivandrum, Malappuram. The case is approved by CGM and the orders will be issued once VC is received from the respective SSAs. We request our District Secretaries to pursue this matter at SSA level for the early vigilance clearance.
2. EPP-Time Bound Promotion: we are informed that the updation of data in revised proforma is in final stage and will be completed shortly.

JAO Phase-II training: : Circle Office has sent a letter to NATFM requesting for scheduling the pending Phase-II JAO training of last batch 2013 LICE JAOs. We were discussing this issue repeatedly and continuously pursuing with PGM(F) and GM(HR&Admin) at Circle Office. We thank Circle Administration, PGM(F), GM(HR) and our CHQ Leaders for the resolution of the issue. We thank our AGS Com Padmanabharao for his prompt intervention and continuous persuasion at Corporate Office as well as NATFM-Hyderabad.

1. Looking After arrangement in SDE(E) Cadre: Association requested to call for option for SDE(LA) against all vacancies taking into account the recent promotion orders of SDE to EE. View CS Letter dtd 15/10/16
2. Promotion & Posting in the cadre of EE: We have also requested to consider the request of few officers recently promoted as EE and posted outside the Circle (delaying the relieving of Officers) as some changes in the postings are anticipated. CE(Electrical) agreed to review the vacancy position once the present promotion status is made clear. Regarding delay in relieving, it was told that CE can hold up to the matter only upto 40 days.
3. Cancellation of transfer order of Sri Akhilesh Chandran JTO Electrical Kannur : The matter was discussed in detail with the CE(Electrical) and requested him to review as the matter was agreed by then CGMT Shri L.Anantharam. GS writes to CMD: Suggestions for Social Security Schemes for the families of BSNL Employees who dies untimely – Entirely to be funded by BSNL Employee on pay roll. View Letter

At present we have a work force of approximately 2.2 lakhs. All the BSNL absorbed employees have completed more than 10 years of service and hence all of them become eligible for Govt pension as per CCS pension Rules 1972. However in the case of BSNL directly recruited employees, as per DPE guidelines, even after implementation of superannuation benefits, they will be eligible for pension only after 15 years of service.

In order to secure the future of the family members in case of any untoward incident to the employees, the following suggestions are made:

I. A voluntary contribution scheme of Rs.15/- for Non Executives and Rs 25/- for Executives (It can be finalized in consultation with all Unions and Associations) for the death of BSNL employee should be circulated among the employees. If say out of 2.2 lakh employees, 2 lakh employees opt for the scheme, family members of the employees will get minimum of Rs. 30 Lakhs. This will be in addition to other eligible benefits to the family members. One time consent of the employees along with the nominee details can be taken who want to opt for the scheme.
This has been recently implemented very successfully in MP Circle in the case of untimely demise of the employees.

II. Another option is to form a Corpus Fund by BSNL, looking to last few years data. Based on the report submitted by field units about death that occurred if any in the Circle, BSNL should release the fund to nominees immediately. Salary unit can deduct Rs. 5/- from the salary of Non Executives and Rs. 10/- from the Executives each month who opted for the scheme and credit it to the Corpus fund. This will ensure that Corpus Fund is maintained at same level on 1st of every month. If any employee who wants to opt out / opt in of the scheme same can be allowed once in a year say, 1st April.


Considering large number of untimely deaths happening in BSNL, management should act very fast to extend support to the families of such BSNL employees, entirely funded by the BSNL employees. It can be discussed with all the Unions and Associations immediately before taking a final decision.

Special General body meeting of Trivandrum District was held at YMCA Hall, Trivandrum on 01/11/2016. The meeting was chaired by District President-Trivandrum Com M.P.Louis and District Secretary-Trivandrum Com VG.Sabu delivered welcome speech. CHQ Chairman Com GL Jogi, General Secretary Com K.Sebastin, CHQ Treasurer Com R.Rajan, Circle President Com George Varghese, Circle Secretary Com T.Santhosh Kumar, Circle Treasurer Com G.Premkumar addressed the gathering. Former District President of AIBSNLEA Com. Satheendran Nair, Accounts Officer, Circle Office joined our association and also attended the convention. He had relinquished his office bearer post just few months back as a protest against the wrong policies of AIBSNLEA. CHQ leaders and SNEA Kerala welcomed Com. GS in his address highlighted the importance of verification. Today 11 Associations are in the process and Management is forced to listen to all of them to have level playing field. Associations with sectional demands are the real problem where Management is very cleverly utilizing them against the interest of the vast majority and the cadre interest. This multiplicity will be over after completion of verification. The majority of the representative Association decides the bargaining power. So, irrespective of the membership, all Executives should elect a single Association as the representative Association to negotiate with the Management with big margin. For early settlement of issues, a strong Executive Association with huge margin is required, otherwise again divide and rule policy will continue for another 3 years. Immediately after verification, important issues are to be settled like standard pay scales for JTO/JAO and SDE/AO equivalent cadres by protecting them from demotion to E1 and E2 scales, enhancement of contribution towards superannuation fund, CPSU Hierarchy upto AGM/CAO/EE to replace the post based promotion linked with seniority, first TBP, 3rd PRC, E1A/E2A scales notionally from 01.10.2000 for Civil/Elect/Arch/PA/PS etc and other important issues. The pay loss of 2007 and 2008 batches is to be pursued after E2, E3, --- pay scales. Meanwhile E1+5 increments is pursued for the JTO/JAOs recruited after 2010 as a temporary measure till E2, E3 scales are implemented.
The 3rd PRC is constituted by our agitation under NCOA and we have to consolidate the revenue and growth during this year to improve the balance sheet. In the presentation to 3rd PRC, we pleaded to delink wage revision and superannuation benefits from profitability. SWAS programme is to be further focused for accelerating the growth. Management is taking lot of initiatives and we have to fully support them. SNEA was in the forefront of all the struggles to protect the interest of BSNL and joined hands with all the Unions and Associations in BSNL. We will continue to do that as our future is directly linked with the future of BSNL.
“The Roaring Lion of SNEA” Com GL Jogi congratulated comrades of Kerala Circle for the valiant and sustained struggle against corruption. He rated the struggle to be the best he has witnessed yet. Com Jogi briefed the history of SNEA, the journey from TESA to JETA to JTOA to TEOA and finally to SNEA, the various struggles for the upliftment of the cadres. BSNL was formed on 01.10.2000 and TEOA was the only Association that fought for pension and terminal benefits for the BSNL absorbed as well as directly recruited employees along with Group C Unions and Rule 37A was introduced. Today all absorbed executives are retiring peacefully with assured government pension only because of the timely trade union action launched by the non-executives federations and TEOA in the year 2000 against corporatization while all others were lured by the unrealistic prospects of corporatization. TEOA was the only Association that fought tooth and nail for absorption on declared terms and conditions (like pay scales, promotion policy and fitment formula), legally and organizationally, when BSNL Management tried their best to coerce employees to get absorbed in BSNL just for an ad-hoc payment of Rs 2000/-. It was only because of this historical struggle that BSNL Management was compelled to reveal terms and conditions of absorption like pay scales, fitment criterion and promotion policy to all executives thus paving the way for absorption in BSNL with dignity and legitimacy, not as bonded labourers. Through sustained struggle, the terms and conditions for absorption such as (a) E1A, E2A, E3, E4, E5 and E6 pay scales for the Executives (BSNL offered E1,E2, E3 ---, E6), (b) five time bound promotions between 4 to 6 years of service (earlier in DoT, only two TBPs) and (c) point to point fixation, were finalised in 2002-03 and simultaneously ensured that the pay scales and promotion policies are equally applicable for the BSNL recruits also. The hike in basic pay was between Rs 3500/ to Rs 5000/ where as the adhoc payment offered by BSNL was only Rs 2000/. Due to our sustained struggles, Terms and conditions for absorption of Executives in BSNL were finalized prior to that of the Non Executives.
The Association fought tooth and nail against unbundling of copper cable and stopping of ADC charges without proper compensation. The Association was always in the forefront to protect the interests of the BSNL and ensure its growth in the face of the worst adversities. The SNEA(I) started the struggle against 45.5M GSM tender cancellation in 2007 by the then Telecom Minister Sri A. Raja. All the Unions/Associations in BSNL, subsequently joined the struggle and stalled the move of the Minister to cancel the whole tender. During the 2nd PRC, Association through serious discussions with the pay panel, ensured 30% fitment through our well studied presentation before the PRC.

Meeting with PGM(Finance) on 31/10/2016: Circle President Com George Varghese, Circle Secretary Com Santhosh Kumar, ACS Com J.V.Ramana, DS-Circle office Com Suneer.S, DP-Circle Office Com Vidya.A met PGM(F) on 31-10-2016 and discussed regarding the pending 2nd phase JAO training of last batch 2013 LDCE JAOs (as the necessary legal opinion has been reached) and the few left out cases. We also requested to consider further Looking after arrangement in CAO/AO cadre in the wake of recent DGM promotions. PGMF Assured to expedite the matter.

Meeting with GM(HR) on 1/11/2016: Circle President Com George Varghese, Circle Secretary Com Santhosh Kumar, ACS Com J.V.Ramana met GM HR on 1-11-2016 and discussed the following:

1. Cancellation of transfer order of Sri Akhilesh Chandran JTO Electrical Kannur issue in the name of ERP without following any norms. In this case it appears that the circle Administration is taking a different stand from other cases as the order was issued in Dec 2014 much before the organisational program of SNEA. We have pointed out that the order was issued in a pick and choose manner in the name of ERP which was taken up by the Assn and kept pending by the Circle Administration. We have pointed out that It was agreed by the CGMT Sri L.Anantharam that administration will review all the cases so that all court case pending can be closed. We have told that all cases except this is already closed as per the assurance and requested to consider the pending case also in the same line.

2. Pending LA cases in Trivandrum: We have pointed out that necessary VC is reached in the circle office and requested for issuing the orders without delay.. GM agreed to look into.

3. Pending EPP cases: GM(HR) reiterated his assurance that it will be completed within short time.

4. SDE LA in Civil Wing: The Assn pointed out that there are more than 15 vacant posts and none recently posted by corporate office has joined in the circle and requested to call for option against all post. We have pointed out Civil JTOs with more than 20 years service and in E4 scale is waiting for LA posting in SDE grade which is in E2. GM HR was of the view that SDE posting can be done only on need basis as there are no JTOs as substitute. We have pointed out that JTOs and SDEs are doing the same job and in future as there is no recruitment as per CPSU cadre hierarchy proposal there is no separate justification for JTO and SDE. We vehemently requested to consider the sane so that at least JTOs with 20 years of service are given LA in SDE cadre. GH(HR) agreed to consider few cases and suggested that if JTOs are ready for transfer some more posting can be considered. We reiterated our request to call for option against all posts and consider the cases favourably. We will be pursuing the matter further.

5. JTO LICE cases in CAT Ernakulam: We have pointed out that the case filed by certain candidates challenging the eligibility to appear for JTO LICE exam is pending and BSNL has not filed the reply. Virtually all JTO posts are reserved and the examinations conducted are becoming meaningless. We requested the Administration to file the reply so that the cases can be disposed and the stalemate on the issue can be sorted out. DGM legal informed that reply from corporate office is received in most of the cases, the circle will file the reply before next hearing scheduled on 4th Nov2016.

GS writes to Director(HR) - Transfer to West Bengal and other Circles during middle of the academic session to meet the shortages is clear violation of the transfer policy, selectively from few Circles which will make a Cycle after every two years – request to reconsider the decision.View GS Letter to Director(HR)
As per the practice followed in BSNL, the shortage in any Circle will be filled by the promotions. Long standing transfers are limited to arrange relievers to such officials gone on promotion, after completion of two years. Recent transfer orders to West Bengal is a clear violation of the above mentioned policy strictly followed in BSNL till recently. While acknowledging the acute shortage of DEs in WB Circle, management should have avoided the long standing transfers, that also at the middle of the academic session. As per transfer policy, long standing transfers are to be implemented at the beginning of the academic year. The SDE to DE promotion or CPSU Cadre Hierarchy should have expedited as a permanent solution.
Representations are received that the transfer orders are issued without following the long stay list and even Executives working in soft tenure/tenure places also included in the transfer order. Again the transfer orders are issued from few Circles only which will create a chain of transfers from such Circles after every two year as substitutes on completion of the tenure. Circles like AP, Odisha and Punjab are victims of such transfers in rotation, for the last so many years.
Further membership verification among Executives Association is in the advanced stage process, no transfer order should have issued after September, 2016.
Considering all these facts it is requested to review the transfer orders and cancel it or keep it in abeyance till promotion orders are issued, which will be the best solution.
We thank our CHQ Leaders for taking up this issue with Corporate Office. 10 DEs from Kerala Circle were transfered earlier to West Bengal inspite of the acute shortages. Dear Comrades,
Let us try to understand in very clear terms the ulterior designs of the policy makers, the government, and collaborators of the govt. in creating a subsidiary tower company owned so called by BSNL. If we have been tracking recent developments in the telecom sector, everyone of us can very easily conclude that every policy decision of the govt., regulator, bureaucracy is unmistakably aimed to facilitate smooth and unhindered roll out of Rjio, even at the cost of BSNL which is nothing but a prestigious and strategic telecom institution of the Country.

In this context, a sustained campaign is launched recently and suddenly by Secy/Dot , bureaucracy and TRAI to create public awareness by propagating that high radiation limits emitted from towers are quite permissible and not dangerous. Suddenly, reports of expert committees are being dug out to justify permissibility of high radiation limits, almost double of what was permissible prior to roll out of Rjio. So that leaves us in no doubt to what extent the govt. is ready to go, even at the cost of human life and unpardonable environmental degradation, to facilitate quick and smooth tool out of Rjio. In the run up to quick launching of Rjio, PM has virtually forgotten that he owns a gigantic telecom company of the country and that it is his fundamental responsibility to fully safeguard the legitimate interests of the company he fully owns. PM in his clamour and lust to promote Rjio , come what may and at any cost , is completely unmindful of the great and unparalleled role that BSNL has all along played in meeting social obligations of telecom policy and converting the dream of every Indian to get digitalised. Digital India is inching towards reality only because of exclusive role of BSNL in creating massive and massive country wide telecom infrastructure in terms of optical fibre, switches, local network and what not. PM needs to be reminded about the great and exemplary contribution of BSNL in making Digital India a reality and the only way to force PM to reckon this reality is through an intense and tireless struggle because the PM is so closely and intimately surrounded by Rjio that only a prolonged and committed struggle will force him to come out of this nexus and recognise ground realities .

Comrades, creation of subsidiary tower company is going to be the beginning of the end of BSNL if we do not defeat successfully this dangerous and well calibrated attack on BSNL to systematically disintegrate it and split it into pieces. The larger and grand design behind this diabolical move of the govt. is to bring in RJio in due course of time as strategic partner of this company and facilitate him to roll out his services by capturing our towers. The larger conspiracy is to disintegrate and destabilise BSNL so as to finally hand over the company to LALAS like Mukesh Ambani, Sunil Mittal etc etc. The govt has started working out in this direction in a well planned manner. The most critical and significant issue is that do we allow this prestigious national telecom institution which is showing visible and positive signs of positioning itself as a challenging, formidable and vibrant service provider in telecom sector once again to decay and eventually die. No, not at all. We have to come out in strongest possible way to expose the sinister plans of the govt. to disintegrate and destabilise this great and beloved company of the Nation. So let us recall our huge capacity to hit back at vested interests with our greatest mite and force and expose their devilish moves to disintegrate this company. Instead, let us get ready to tear this govt. into pieces for its sinister plans to tear this company into pieces. Let us this get ready for what is going to be truly a historical struggle to save our beloved company from disintegration. Posterity should remember us as heroes for saving this prestigious national telecom institution from being sold to vested interests. It is real testing time for our unity and solidarity to safeguard our beloved company the way we have safeguarded it so far.

In a brief function arranged during lunch hours at RTTC Seminar Hall on 24.10.2016, DS TVM Dr. V G Sabu introduced all Circle, District and Branch Office bearers present during the occasion to the trainees and offered unconditional support from SNEA to all in making positive contributions to our beloved company BSNL. Leaders reminded the gathering that SNEA has always been the binding and driving force of Executive-Non Executive unity and joint struggle in all policy based issues either of the government or of the Company and reiterated our commitment to safeguard the best interests of all employees of BSNL in general and Executives in particular.

SNEA is fully committed to the growth of the company and the career progression of the Executives. Leaders also mentioned about the achievements of Executives in the past in all those fronts due to sustained struggle by SNEA and its role in ensuring the best packages of Pay, Pension & Promotion especially with regard to our ongoing struggle for the implementation of 3rd PRC, Standard pay scales, Superannuation benefits and Time bound functional promotions.

Beware... Brokers are roaming, claiming proximity to corridors of Power...

It has come to our notice that the Consistent and Persistent group is approaching JTOs who were posted in August 2014 on LICE promotion, assuring their transfer by claiming proximity to CGMT and Circle administration. It is told that they are ready to be brokers for a meeting with CGMT for these executives (Most likely photograph will also be seen).

In this connection SNEA can confidently assure that all the requests for transfer of executives in Kerala circle who has completed more than two years stay will be effected at least by March 2017 while all efforts will be made to make use of the very opportunity to effect the same before March. All attempts will be made to start the process even before by making use of all opportunities. We are sure that no force (administrative or so called associations) shall dare to deny the above legitimate requests.

No one can forget the recent history of Kerala circle -which has ventured to dilute the transfer policy.... and who supported such arbitrary violation of transfer policy ??? Neither the history nor the Executives of Kerala Circle can forgive them for their Anti-Employee policies.

As far as the JTOs promoted under LICE in 2014 is concerned, we don’t want to repeat the consistent and Persistent efforts made by the so called brokers, when LICE was notified, examination was held, result was published and when the appointment was done by moving pillar to post to see that no such promotions are made till all Officiating JTOs are regularized. They could not open their mouth when all of you including ladies and officiating JTOs were posted to far off places like Trichur and beyond, in the name of rationalization of posts in Kerala Circle.

Dear comrades, the history is known to you. Those who have tried to prevent your birth as JTOs are now pretending to be your guardian. We are sure that you have become JTO after a series of struggle organizationally and legally and no one can befool you. Stand of SNEA was open and well known to all on issues like JTO promotion and transfer issues. We once again assure that there is no reason for any anxiety regarding the transfer requests. It will be our endeavour to ensure that all transfer requests are considered atleast by March 2017. This time there are only 60 such executives who have completed two years of service and waiting for transfer, while it was 255 in March 2016. When the transfer request of these executives were denied by the then Circle Administration these groups were consistently and persistently involved in supporting their King by press release, notices , meeting and even by approaching the Courts . Hundreds and Hundreds of SNEA members have shed their blood and sweat even risking their job by facing police action court case, dies-non, charge sheets , reversion etc…. against corruption, arbitrariness, denial of trade union rights and to achieve the legitimate interest like transfer etc of executive community. We still proudly and happily licking over these wounds which were inflicted on us in the course of our action to safeguard the interest of executives and to uphold their dignity.

We once again assure all executives to be confident that all their genuine interest will be protected and no can snatch away it from them since we have rooted out such elements for ever.

In the presentation to 3rd PRC, we pleaded to delink wage revision and superannuation benefits from profitability. SWAS programme is to be further focused for accelerating the growth. Management is taking lot of initiatives and we have to fully support them. SNEA was in the forefront of all the struggles to protect the interest of BSNL and joined hands with all the Unions and Associations in BSNL. We will continue to do that as our future is directly linked with the future of BSNL.

Stalemate in Phase-7+ GSM/3G expansion: The association had discussed with Circle administration, the stalemate in Phase 7+ GSM/3G expansion. The Phase 7+ GSM/3G expansion project in Kerala Telecom Circle has come to a standstill with virtually nil support for almost one month from the Vendor, M/s ZTE. The warehouse in the circle at Ernakulam where BSNL materials are kept and operated by the vendor for smooth roll-out of the project is in closed condition for more than 3 weeks. Movement of material in and out of the warehouse has been affected. It is learnt that disputes exist between the vendor and the sub vendor who operates the warehouse. Also, the sub vendors who are deployed by the vendor in the circle to carryout installation works are in total noncooperation as well thereby stalling entire activities related to network expansion including Phase 7+ roll out, Phase 7 closure, O&M of the working equipments in Phase 7/ 7+ and redeployment of BTSs/NodeBs.
We are informed that CGMT has taken up this matter with DIR (CM) for the resolution of the issue at Corporate office. The circle association has sent the details to General Secretary for taking up this matter at CMD and DIR(CM) at corporate office level as the case is badly effecting the expansion under ph7+. And it is most likely the same in other circles also where M/s ZTE is the vendor.

Government is moving fast in the direction of forming Tower Subsidiary Company of BSNL, which will be detrimental to the future of BSNL. The Core committee meeting of the Forum decided to conduct demonstrations on 27.10.2016, at the Corporate Office, Circle and SSA HQs opposing formation of the Subsidiary Tower Company. The future course of action on this issue will be decided in the next meeting of the Forum, to be held on 17.11.2016.

SDE(C) to EE(C) DPC is completed for all the vacancies upto 2015-16. DPC for 2016-17 will be held next week. GS and AGS met Jt GM(Pers) and held discussion on the hearing of the JTO to SDE promotion case at Ernakulam HC to clear the hurdles on promotion. Now there is no stay from Chandigarh but promotions are held up due to the cases at Ernakulam and Allahabad. Since the Sr Lawyer engaged by BSNL is not well and could not travel, the hearing is not completed. Jt GM informed that management is in touch with the lawyer and two days back also spoken to him and a decision will be taken by next week regarding the date after consulting the lawyer once again.

GS, CHQ President, Chairman and AGS met Sri Anupam Shrivatava, CMD BSNL on 20.10.2016 and strongly protested against the repeated postponement of membership verification without any valid grounds. We reminded him about the assurances given by him and DIR(HR) few weeks back that verification will not be postponed. In the name of verification, all the issues remain unaddressed. This is going on since 2014. The status of CMD and top management is getting degraded in the eyes of the employees by some elements, we clearly told CMD. All our Executives are geared up for the first MVP and concentrating more and more in SWAS programme and increasing the revenues of BSNL, keeping the larger task of implementation of 3rd PRC.
CMD appealed not to precipitate the matter further and assured that there will not be any more postponement and verification will be held as per schedule on 07.12.16.
Comrades, those who are afraid to face membership verification will try their level best to derail the verification for continuing to enjoy the benefits without the support of Executives and membership. They are not only trying to derail the verification, in the process further delay the settlement of HR issues. They are deliberately doing this as they are not affected by pay scales or CPSU Cadre Hierarchy. We have to expose them and defeat such negative elements through the ballot on 07.12.2016. We have to continue the campaign with same vigor fully utilizing the additional 3 weeks.
Assn further requested CMD for expediting JTO to SDE and SDE to DE promotion as there is no stay on promotion. There are about 2000 DE vacancies. JTOs and SDEs are retiring without promotion. Since there is no stay, management can go ahead with promotions as per DoPT rules giving reservation for SC/ST Executives by filing an appeal in the higher courts. SEWA BSNL General Secretary Com N D Ram also was with us while discussing this issue with CMD, BSNL.

Meeting with GM(HR&Admin) on 19/10/2016
Circle Secretary Com T.Santhoshkumar, Circle Treasurer Com G.Premkumar, Circle Vice-President Com Narendra Kumar, ACS Com J.V.Ramana and Circle Office District Secretary Com Suneer.S met Shri Mohan.D GM(HR&Admin) to discuss various pending HR issues. Shri R.Satheesh DGM(Admin) and Shri James Sagayaraj DGM(HR) also attended the meeting.

SDE(LA) in Civil wing: We have pointed out the shortage of SDEs in Civil wing. As around 25 vacancies are there all over Kerala and JTOs having more than 20 years of service are still waiting for their first promotion, we once again urged GM(HR&Admin) to consider providing Looking After option to these demotivated JTOs. GM(HR) expressed concern over the possibility of shortage of JTOs if they are given SDE(LA) as every layer in Civil wing is important. We argued that implementation of CPSU cadre hierarchy in future will also create such situation but maintaining motivation levels of our staff is equally important. These JTOs are working in the same cadre for more than 20 years. GM(HR&Admin) responded positively and finally agreed to consider issuing SDE(LA) for few JTOs.

Cancellation of Transfer order of 10 DEs from Kerala to West Bengal: We have pointed out the shortage of DEs in Kerala Circle. The total number of sanctioned DE post in Telecom Operations in Kerala Circle is 382 and the present working strength is only 122 which is a mere 32% of the sanctioned strength. Kerala Circle is facing acute shortage of AGM/DE posts. For the last 5 years large number of DE’s have been posted in Kerala Circle from neighbouring Circles like Karnataka, Andhra Pradesh and Tamilnadu to meet the shortage of DE posts in Kerala Circle. Today Corporate Office has released transfer orders for 9 more DEs to their requested Circles- Chennai, Tamilnadu and Karnataka, further reducing the working strength of Kerala Circle. In spite of the shortage of Executives, Kerala Circle is the only Circle making profit continuously ever since the formation of our beloved company BSNL. In these circumstances it is most unfair to transfer 10 AGMs/DEs from Kerala Circle to West Bengal Circle. The transfer order issued by Corporate office at this juncture is unwarranted and it will definitely demoralize the entire executive community who are tirelessly working hard to make more profit to Kerala Circle.
GM(HR&Admin) agreed to our views and informed that as pointed out by the association today morning CGMT Kerala has sent a strong letter in this regard to Director(HR).

Pending EPP – Time bound Financial upgradation: We reiterated the delay in issuing the orders regarding Time bound Financial upgradation. We expressed our concern over the delay. Large numbers of cases are pending for more than two years. GM(HR) responded positively and assured for the early release of orders. GM(HR) also suggested for decentralization of EPP work to the SSA’s as it will reduce the delay as well as reduce the workload on Circle Office. We agreed and supported his suggestion.

Publication of JAO LICE Select list and Phase-1 training: We expressed our concern over the delay in publication of JAO LICE Select list and their Phase-1 training which is going to commence on 24/10/2016 for all Circles except Kerala. GM(HR) assured that training for Kerala Circle also will commence on 24/10/2016. The stalemate in declaring select list is almost over and a final decision will be taken on 20/10/2016. Efforts are on for training at RTTC TVM.

JAO Phase-II training: We expressed our concern over the delay in Phase-II training for JAO’s who got regularized and posted after sustained efforts and legal struggles since 2012. GM(HR) responded positively and informed that they have sent the file for legal opinion as per Corporate office instructions. The legal opinion is received from the legal counsel and the file is under processing.

JTO LICE – Declaration of results: We expressed our concern over the delay in filing reply to the court cases at CAT Ernakulam (OA nos 310/16 by Venugopal & others, OA nos 330/16 by Suresh.VP & others, OA No 299/16 by Gireesh & others, OA No 336/16 by Anoop & others, OA No 337/16 by Sajith Senan & others) regarding the eligibility for appearing JTO LICE. Association requested for necessary early action for the disposal of the pending court cases at CAT Ernakulam. GM(HR) informed that the hearing is in the second week of Nov2016 and the reply affidavit is under processing.

SDE(LA) to Trivandrum Comrades Com. Lalitha Radhakrishnan and Com. Anilkumar: We expressed our concern over the delay in issuing SDE(LA) orders to Com Lalitha Radhakrishnan and Com Anilkumar. Com Lalitha, was reverted in 2014 due to the vindictive actions by the then Circle Administration. Com Anilkumar was transferred to Kollam from Trivandrum on longstay basis in spite of his bad health but eventually got relaxation on medical grounds after a long struggle. GM(HR) responded positively and informed that VC was called from SSA and has reached Circle Vigilance and is under processing. Orders would be issued soon after receiving VC.

We informed that all our executives are geared up for the First MVP and decided to concentrate more in strengthening and increasing the revenues of BSNL, keeping the larger task of implementation of Third PRC. But the BSNL Management has shattered all the plans of SNEA without taking into consideration of the feelings of all the stake Holders. Chairman and AGS met GM SR and informed the discussions we had with CMD. We also protested with GM SR on the postponement of First MVP.

JAO LICE stalemate: As usual The Consistent & Persistent Team re-surfaces

Once again, as usual, as in other cases, when final results are being reached, the Consistent & Persistent Team has resurfaced with Congratulations which may be the only thing that they are capable of.

SNEA was interacting at Circle office, Corporate office, NATFM regarding the training and publication of JAO eligibility list of LICE held on 17/7/2016 of Kerala Circle. We were discussing these issues repeatedly with PGM(F), GM(HR&Admin) at Circle Office and with GM(Rectt), GM(FP) at Corporate Office. Our CHQ AGS Com PandmanabhaRao also had talk with PGM(F) of Kerala Circle and NATFM authorities. (Kindly refer the updations of this website dtd 15/10/16, 6/10/16, 4/10/16, 1/10/16, 30/9/16, 24/9/16 and 28/8/16)

It was assured by Circle and Corporate Office that the stalemate in publication of JAO results will be resolved so that the interest of candidates from Kerala Circle will not be affected. As the matter involves certain intricacies, Circle office is handling the matter very sensitively and carefully.

The Circle Office is in touch with Corporate office and NATFM in this matter so that the training of candidates from Kerala Circle also can be started on 24/10/2016 along with other Circles. We also urge Circle Administration and NATFM for allotting the training at RTTC Trivandrum. Circle Secretary writes to CGMT regarding Publication of JAO eligibility list for the LICE held on 17/7/2016 and request for arranging training at RTTC, Trivandrum View CS Letter
This Association has repeatedly requesting Kerala Circle Office and BSNL Corporate office for resolving the stalemate in publication of eligibility list of JAO LICE results of Kerala Circle held on 17/7/2016. NATFM has already finalized the training schedule of all Circles commencing on 24/10/2016 except that of Kerala Circle. It is reported that Corporate Office has suggested the ways and means for the resolution of this issue to Kerala Circle.
Hence we once again requested Circle Administration for the publication of results and taking up necessary steps for arranging the training with NATFM at RTTC Trivandrum. In this connection it is also reported that there is acute shortage of faculty in Finance wing at RTTC Trivandrum and we requested Administration for providing necessary faculty in Finance wing at RTTC, Trivandrum. JAO LICE Issue: Circle Secretary and ACS met GM(Finance) Shri K.Vel regarding the stalemate in publication of JAO LICE results of Kerala Circle. We urged GM(F) to resolve the issue at the earliest. GM(F) responded positively and it was told that the matter is being discussed with Corporate Office and the issue would be resolved soon and the training process would be initiated at the earliest.

JAO Phase-II Training issue: As instructed by Corporate Office, Circle Office has sought legal opinion in this regard.

JTO LICE issue: Circle Office has sought approval for the reply affidavit to be filed in CAT Ernakulam from Corporate Office. It is assured that Circle Office will pursue the matter so that the case can be heard at the earliest.

CHQ News: Meeting with Member(Fin), DoT for E2, E3 pay scales approval
GS and AGS met Member(Fin) Sri Prahlad Singh on 14.10.2016 and held discussions on the issue. GS explained to Member(F) similar cases in other CPSUs like BHEL, NTPC and FCI where intermediary pay scales are replaced with next higher standard pay scales. We requested to clear the proposal at the earliest as 3rd PRC is already constituted. This proposal is part of second PRC. We explained the BSNL proposal in two parts and the reason for that. On specific query, we explained that the proposal is in line with the DPE guidelines, DoT can take decision based on the proposal of BSNL and there is no need to send the proposal again to DPE. Member (Fin) was positive and assured that he will try to settle the issue positively.
Earlier, GS and AGS met Director(TPF), DoT and discussed about the queries made by Member(Fin). Last week, the file has been returned by Member(Fin) with certain queries. Dir(TPF) informed that as suggested by Member(Fin), the proposal resubmitted with the reply. It was informed that the proposal is resubmitted with positive recommendation.

GS met GM(Estt) Smt Madhu Arora on 13.10.2016 and held discussions on the following issues:
Notional pay of E1A and E2A w.e.f 01.01.2000 for the JTO/SDE(C/E/Arch), PA, PS etc: As per the direction of the Management Committee, the data collected from other three departments like Railways, Posts etc to compare the pay of JAOs and JTO(C/E) in those departments. As per the data, in all the departments, the pay of JAOs and JTO(C/E) are different. In the case of JAOs, the pay has been revised as per the decision of Ministry of Finance, notionally from 1996 and on actual basis from 2003. This information has been furnished to the management Committee. The details from MTNL also will be collected and it will be submitted to the MC for taking a final decision.

Formation of the trust to manage the superannuation fund: The CA section is processing the case. Discussion is going on with LIC to manage the fund. Since LIC is giving sovereign guarantee, it may be the best fund manager with less risk. The entire 3% will be credited towards pension fund.

FR22(1)(a)(1) pay fixation case for the officiating JTOs: Requested to give direction to BSNL lawyer not to oppose the matter in the next hearing date and delay the decision as the matter is already decided by the court in other cases.

History, Status and Vision of SNEA on Time Bound Functional promotion or CPSU Cadre Hierarchy:

Time Bound Functional promotion or CPSU Cadre Hierarchy is not a new concept or demand for the Executives in BSNL. In true sense, it is the implementation of the terms and conditions for absorption finalised by the agitation of TEOA (now SNEA) in 2002-03.

After Group C employees absorption in BSNL as Non Executives with an adhoc payment of Rs 1000/-, BSNL management initiated the process of absorption of Group B officers with an adhoc payment of Rs 2000/-. TEOA (SNEA) was the only Association opposing the absorption process without deciding the terms and conditions for absorption like 1) Pay scales, 2) Promotion Policy and 3) fitment formula. All other Associations were ready for absorption just for Rs 2000/-, without even knowing the terms and conditions. With the help of these Associations, BSNL Management and DoT gone ahead with absorption of DoT Officers in BSNL and MTNL. TEOA legally and organizationally fought against this and stayed the absorption process. Finally TEOA won the legal battle and Hon Court directed BSNL to decide the terms and conditions before calling for option for absorption.

After this successful legal battle, TEOA(SNEA) alongwith MTNL EA and newly formed BSNLEA (TEOA and BSNLEA merged in 2003 and SNEA formed), launched agitation in 2002 in the banner of Executive Negotiating Council (ENC) demanding finalization of terms and conditions for absorption like pay scales, promotion policy and fitment formula in BSNL and MTNL. During the initial stages of struggle, management took a position that the settlement will be applicable only for the officers absorbing into BSNL and not for the BSNL recruits. For the BSNL recruits, E1 pay scales only will be implemented and for the absorbees additional increments will be given considering their experience. But TEOA didn’t allowed this discrimination to happen and insisted for the same pay scales and promotion policy, uniformly for all the BSNL Executives either absorbed or recruited directly by BSNL and agreed for negotiation only after this assurance, protecting the interest of BSNL direct recruits also. As settlement of struggle, agreement reached between ENC (TEOA, BSNLEA and MTNLEA) and the management for a) E1A, E2A, E3 ---- E6 pay scales, b) Five Time Bound Functional promotion from JTO equivalent cadres upto Selection Grade JAG (SG JAG) between 4-6 years and c) point to point fitment for all the BSNL Executives, recruited or absorbed in BSNL.

It will be worthful to mention here the earlier history also. In DoT, JTO and SDE are the only two cadres in which time bound promotion concept was introduced in 1990, first time in the history of any Central Government department. That also after country wide joint struggle by JTOA(I) and TESA. This unique decision was taken by the Union Cabinet as in the case of 1640-2900 pay scales struggle in 1987. By this scheme, JTOs granted SDE pay scales after 12 years of service and SDEs granted Sr SDE pay scales after 12 years of service. Later similar ACP scheme implemented for all the Central Government departments as per recommendations of Vth CPC.

In 2005, SNEA and AIBSNLEA launched agitation programmes demanding implementation of Time Bound Functional promotion or CPSU Cadre Hierarchy. However we couldnot succeed fully and EPP implemented with two parts, I) Time Bound Financial upgradation and II) Post based promotion.

Since all post based promotions are getting delayed due to litigations, United Forum (SNEA, AIBSNLEA and AIGETOA) repeatedly taken up the issue of CPSU Cadre Hierarchy with the management and started organizational actions and a Joint Committee was constituted in 2012. However the Joint Committee was practically defunct. In the few meetings, all the proposals brought to the Joint Committee by the management side proposed 15%, 30%, 50%, 65% dropping at each level as done in other CPSUs, which outrightly rejected by the United Forum.

Since the management side proposal of replacement scales for E1A and E2A with E2 and E3 w.e.f 01.01.2007 is not agreed by others in 2013, SNEA alone started organizational actions since February, 2014 pressing for 1) standard pay scales of E2, E3, 2) CPSU Cadre Hierarchy and other demands. Again SNEA launched agitation in Sept, 2014 and April-May, 2015 which resulted in the reconstitution of the Joint Committee with a dynamic absorbed officer as its new Chairman. Further CMD directed the Jt Committee to meet regularly atleast once in a fortnight and submit the recommendations in 3 months time. Our vigil and continuous efforts in the Jt Committee resulted in a very positive and sweeping recommendation from the Jt Committee, in 4 months time which recommended the following in the case of CPSU Cadre Hierarchy:

a) JTO and equivalent cadres with 5 years of regular service in the grade will be promoted to SDE equivalent grade.

b)SDE and equivalent cadres with 5 years of regular service in the grade will be promoted to Sr SDE equivalent grade.

c) Sr SDE and equivalent cadres with 5 years of regular service in the grade will be promoted to DE equivalent grade.

d)The Executives already promoted to the higher post on post based promotion will stand enbloc senior to others.

e) Promotion to DGM grade will be restricted to the availability of posts. A new designation of Jt DGM(NF) is recommended for those Executives eligible for DGM promotions.

Comrades, what we could not achieve in 3 years from 2012 to 2015 in the Joint committee, SNEA could get it in 4 months, in the form of a very positive recommendation on standard pay scales of E2/E3, CPSU Cadre Hierarchy and first TBP from the re-constituted Joint Committee through our agitation.

Past few years, promotions in all the cadres are stopped in BSNL due to litigations on various grounds like seniority, date of joining, availability of posts, reservation etc etc. The only viable alternative is CPSU Cadre Hierarchy, where the promotions are delinked from seniority, availability of posts, date of joining, reservation etc. In fact CPSU Cadre Hierarchy is the implementation of the settlement reached with SNEA in 2002 and become part of the terms and conditions for absorption, in true sense. Now our agitation is for the implementation of the settlement reached in 2002. To start with, United Forum also made some compromise, limiting the Time Bound promotion upto AGM level where as our original demand was Time Bound promotion upto DGM grade.

As of now, the grades and scales are different in BSNL. There are thousands of Executives working in higher scales but in lower grade. For example, thousands of SDEs are working in E5 scales but there are DE/AGMs in E4 scale. Thousands of JTOs are working in E3/E4 scales but there are SDEs in E2A scale. The Joint Committee didn’t make any recommendation how to place the Executives working in higher scales in the CPSU Cadre Hierarchy structure. This issue is left to the BSNL management to decide.

As per the recommendations, Sr SDE/Sr AO equivalent grade will become a new functional grade, in future, after implementation of CPSU Cadre Hierarchy. Sr SDE/Sr AO grades are not available now, after the implementation of EPP in BSNL. The time bound promotions are given from one scale to the next higher scale. Since there are no Sr SDE/Sr AOs working in BSNL as of now, nobody is eligible for DE/AGM/CAO promotion after the implementation of CPSU Cadre Hierarchy for the next five years till Sr SDE/Sr AO completes five years. So, UF suggested promoting SDE/AO with 10 years of service as AGM/CAO/EE for the next five years. Since CPSU Cadre Hierarchy is going to be implemented upto AGM grade, Executives working in JTO, SDE and Sr SDE equivalent grades will directly report to AGM.

After the submission of the recommendation, SNEA is constantly demanding its implementation with the following additional demands and pursuing for that vigorously.

1)For the Executives working in higher scales, immediate promotion to the next higher grade.

2)For the Executives working in two or more higher scales, relaxation in qualifying service for the second promotion.

3)Uniform date of promotion and uniform date of increment to avoid anomaly.

4)Decentralised DPCs. DPCs should be done at Circle level.

5)Change of designations.

6)Increasing the number of DGM posts.

7)Reserving 50% GM posts for the promotees.

Most of our above demands are accepted by the management in the draft proposal. Time Bound Functional Promotion without linking with seniority and availability of posts are agreed for the first two promotions upto Sr SDE/Sr AO grade, after every five years.

However major challenge before us is to make promotions to AGM grade also time bound, without linking with the availability of posts. Since thousands of Executives are eligible for AGM promotion, it will be the toughest task for the next five years. Similarly promotions above AGM are to be delinked as it is not related with CPSU Hierarchy or Joint Committee recommendations and MT recruitment to be abandoned with a suitable and viable alternative mechanism. In AGM promotion, all seniority related issues will be nullified once for all on implementation of CPSU Cadre Hierarchy and all the SDEs in seniority list 6 & 7 to be covered and SDEs in seniority list 8 also to be considered for promotion, that is our demand. CPSU Cadre Hierarchy or Time Bound Functional promotion without linking with availability of posts is implemented upto AGM grade, it will be the fulfilment of our dream since the settlement in 2002. Later on we can pursue CPSU Cadre Hierarchy upto DGM grade as per the settlement in 2002 and the terms and condition for absorption.

Our agitation in 2014 and reconstitution of the Joint Committee in May, 2015 through our agitation are the turning points. Those agitations lead to the historic recommendations. Agitation with the same vigour has to continue for its implementation. For that purpose, each and every Executive has to strengthen SNEA.

CS writes to CGMT to review the decision of opening CSCs on Holidays:

Circle Office has issued instructions for making CSCs (Cat-I, Cat-II and Cat-III) to be operational on Holidays from 8-10-2016 to12-10-2016.

It is reported from even many of the Type-I CSCs that the customers turn up is very minimal on holidays. In some CSCs even the customer visit is NIL. In majority of the CSCs the total revenue earned during holidays is less than the total expenditure incurred on electricity usage. Besides, if we are engaging manpower on holidays without getting much business in return, compensatory OFF has to be given to them on another working day which in turn will badly affect the normal business days. Executives being responsible for arranging the duty on holidays are finding it difficult to compel the staff to attend duties on holidays without proper justification.
We are of the view that as our Company is doing business, we may act upon business point of view and if we found that any of the CSC is earning more revenue than the expenditure, definitely we must open that CSC for the sake of our business.
So we requested CGMT to give necessary instructions to the concerned authority to rethink in this matter and a comprehensive analysis may be conducted regarding the revenue and expenditure earned through CSCs on holiday’s working.

JAO LICE Issue: CHQ President Com AA Khan & AGS Com Padmanabha Rao met GM(FP) regarding the stalemate in publication of JAO LICE results of Kerala Circle. They urged GM(FP) to resolve the issue at the earliest. It was told that the matter was discussed by GM(FP) with PGM(F) of Kerala Circle and necessary instructions are given to the Circle to resolve the issue based on DOPT guidelines.
Circle Association discussed the issue of JAO LICE result with GM(HR) for early resolution. It was informed by GM(HR) that he had a personal discussion with GM(Rectt) Corporate Office and the Recruitment Cell had informed that the matter is to be dealt by GM(FP) Corporate Office. Accordingly GM(HR) requested PGM(F) to discuss this matter with GM(FP) for the resolution of the issue.

Delay in Timebound Financial upgradation through EPP : Circle Association expressed concern over the delay in releasing promotion orders under EPP. We have pointed out that many 2015 cases are still pending and urged for release of the orders immediately. GM(HR) informed that the matter is being processed by the section. We will further verify the status with the HR section tomorrow.

CS writes to CGMT Kerala seeking immediate intervention in the unwarranted transfer of 10 AGMs from Kerala to WestBengal Circle :

The total number of sanctioned post of AGM/DE in Telecom Operations in Kerala Circle is 382 and the present working strength is only 122 which is a mere 32% of the sanctioned strength. While Kerala Circle contribute more than 10% of total BSNL revenue and hold more than 10% of assets like land line ,BB and GSM, the sanctioned strength itself is much less compared to the sanctioned strength of other Circles (only 382 posts out of 5200 posts, i.e 7%).

On analyzing the sanctioned strength and working strength it is clear that Kerala Circle is facing acute shortage of AGM/DE posts. For the last 5 years large number of DEs have been posted in Kerala Circle from neighbouring Circles like Karnataka, Andhra Pradesh and Tamilnadu to meet the shortage of DE posts in Kerala Circle. In spite of the shortage of Executives, Kerala Circle is the only Circle making profit continuously ever since the formation of our beloved company BSNL.

In these circumstances it is most unfair to transfer 10 AGMs/DEs from Kerala Circle to West Bengal Circle. At present there is no pending transfer to Kerala Circle from outside circle in connection with long stay transfer. So the transfer order issued by Corporateoffice at this juncture is unwarranted and it will definitely demoralize the entire executive community who are tirelessly working hard to make more profit to Kerala Circle.

Moreover transferring employees during the middle of the academic year is totally against the prevailing rules and procedures of Executive Transfer Policy. Besides the Membership verification among Executives is in advanced stage so the transfer of Executives in this stage is a violation of code of conduct of election rules. It is also reported that many officers who had served/serving in hard tenure area (Lakshadweep islands) are also included in the order. West Bengal was recently declared as tenure circle and officers at the age of above 55 years are also transferred by the above order.

In these circumstances we humbly request Circle Administration to takeup the issue with Corporate Office at the earliest and ensure the cancellation of above said order as early as possible to protect the interest of the circle as well as to boost the morale of the executives.

JAO Phase-I training : As we have already reported, NATFM has decided to go ahead with the training schedule except that of Kerala Circle. View orders We once again urge upon the Circle Administration to resolve the issue immediately to safeguard the genuine interest of the eligible hands as well as that of the Kerala BSNL.

JTO LICE: Circle Office has sought approval for the reply affidavit to be filed in CAT Ernakulam from Corporate Office. It is assured that Circle Office will pursue the matter so that the case can be heard at the earliest.

Unjustified Transfer orders for 10 DEs from Kerala to West Bengal Circle View orders
Corporate Office has issued transfer orders of 10 DEs from Kerala to West Bengal Circle. SNEA Kerala strongly protest against this unjustified and untimely transfer orders. At present there is acute shortage of DEs in Kerala Circle which is around only 60% of sanctioned strength and DEs from other Circles like Karnataka, Tamilnadu, Chennai TD and AP are working in the Circle. Kerala being the only profit making Circle of BSNL, executives of Kerala deserve a reward rather than transfers to out of Circle which is demoralizing one. We urge Circle Administration and SNEA CHQ to intervene in this matter to protect the interest of the BSNL Kerala Circle as well as that of the executives. Circle Secretary has taken the case to the CHQ for intervention.

JAO LICE & Training: CHQ AGS Com PadmanabhaRao met GM(F) Shri Sunil Kumar and discussed the stalemate in releasing the select list of Kerala LICE JAOs. He apprised the GM that training schedule of NATFM for JAOs is held up for the entire BSNL because of this issue of Kerala circle. GM(F) assured that he will discuss the issue with Kerala circle on Monday and will be resolved immediately.
Circle Association discussed the Phase-II training of JAOs and the stalemate in publication of LICE JAO result of Kerala circle with GM(HR) and requested to take necessary action as instructed by corporate office. GM(HR) assured that he will personally speak to corporate office regarding publication of LICE JAO results and seek legal opinion regarding JAO Phase-II training as instructed by corporate office.

JTO LICE: The Association brought to the notice of Circle Administration the delay in filing reply to the court cases at CAT Ernakulam (OA nos 310/16 by Venugopal & others, OA nos 330/16 by Suresh.VP & others, OA No 299/16 by Gireesh & others, OA No 336/16 by Anoop & others, OA No 337/16 by Sajith Senan & others) regarding the eligibility for appearing JTO LICE. As the case is pending, results of previous examination is withheld and hence the ensuing further LICE are becoming meaningless. Association requested for necessary early action for the disposal of the pending court cases at CAT Ernakulam.
